MPs of the Black on White coalition in the Parliament of Montenegro submitted an initiative to the Constitutional Court of Montenegro for the evaluation of the consent of the members Zof the Act on Freedom of Religion or Belief and the Legal Position of Religious Communities, with the Constitution of Montenegro and confirmed and published international treaties.
They did this because, as they explain, they have no problem with the legal solution they voted for in parliament being examined at the highest institutional level, especially bearing in mind that the Law on Religious Freedoms has caused numerous controversies in the public.
"Every physical and legal person, including religious communities, is obliged to respect the cultural property of others, in the same way as their own, and the right to access cultural property can be limited only to protect the public interest and the rights and freedoms of others. Therefore, the state is obliged to protect cultural assets, which is elaborated in detail by the norms of the Law on the Protection of Cultural Assets, which is written and harmonized with international regulations. The question arises whether Article 12 of the Law in question, which reads "In cases of relocation, removal from the state or alienation of goods that represent the cultural heritage of Montenegro, and on which the right of ownership is held by a religious community, the provisions of the law governing the protection of cultural goods are applied .", represents a sufficient guarantee for the protection of articles 77 and 78 prescribed by the Constitution of Montenegro," states the initiative signed by all MPs of the Black on White coalition in the Parliament of Montenegro, Miloš Konatar, Bozena Jelušić, Srđa Pavićević and Suada Zoronjić.

MPs of the Black on White coalition also initiated an investigation into whether Article 12 of the Law on Freedom of Religion is in accordance with the Constitution:
"The goal of this initiative is to confirm that the property of the state of Montenegro is protected, that no one will and cannot take away, alienate or appropriate something that belongs to our state".
From the Black and White Parliamentary Club, they are convinced of the correctness of their decision to vote "for" and the need to pass this Law in order to regulate the rights and obligations of all religious communities.
"Therefore, with a clear conscience, we are submitting to the Initiative for the evaluation of constitutionality because we are sure of the "quality" of the law and that there is nothing in it that would endanger this state and the faithful", they conclude.
The amended Article 12 of the Law reads: "In cases of relocation, removal from the state or alienation of goods that represent the cultural heritage of Montenegro, and to which the religious community has the right of ownership, the provisions of the law regulating the protection of cultural goods shall be applied."
