The prosecutor's council is elected on Saturday?

The session of the Parliament of Montenegro, at which the members of the Prosecutorial Council (PS) should be elected from among distinguished lawyers and NGOs, could be held tomorrow if the ruling parties agree on the candidates.

"Vijesti" sources say that, if the parliamentary session is held, a new president of the State Election Commission (SEC) will also be elected at it.

One of the leaders of the Democratic Front (DF), Milan Knežević, announced on Tuesday that this political alliance is ready to temporarily return to the Assembly and vote for TS members by July 31. His announcement was welcomed by the Deputy Prime Minister and URA GP leader Dritan Abazović, who said that he expects "all subjects to support this process" and that no one will obstruct justice.

Amendments to the Law on State Prosecution stipulate that the TS has 11 members - five each from the ranks of prosecutors and prominent lawyers and NGOs, and one representative of the Ministry of Justice. Lawyers and representatives of the Ministry of Justice are elected by the Assembly by simple majority.

The intention of the new government is to change the composition of the TS to open the way for the dismissal of acting VDT Dražen Burić and the dismissal of the chief special prosecutor Milivoj Katnić, because the new government is dissatisfied with the results of the work of the Prosecutor's Office, considering that it did its work selectively and was under the political influence of the former government.

Yesterday, at the session of the Committee for the Political System, Judiciary and Administration, Burić said that a list was drawn up for the selection of members of that body from the ranks of state prosecutors. He said that the conference of state prosecutors, where TS members will be elected from among prosecutors, is scheduled for August 3.

DF MP Predrag Bulatović said yesterday at the Committee that the prosecutor's organization broke the deadlines for the selection of members of the TS from among the prosecutors and that it is preparing obstructions at the conference.

"I seriously suspect that obstruction is being prepared at the prosecutor's conference - not to elect members of the TS, in order to postpone personnel changes, primarily Dražen Burić. Because the longer the election of the TS is postponed, the further it is delayed for that body at its first session to determine the expiration of the mandate of the acting VDT and appoint a new one. I think they should appoint a new one," he pointed out.

Bulatović said that it is clear that certain prosecutorial structures are trying to present that the Parliament is not working in accordance with the Constitution.

"And they work in accordance with the Constitution, and there are no results in the fight against high corruption... I think that the Parliament should elect TS and I call on all opposition representatives to open a broad discussion by the end of the regular session to reach a solution, to send a message to the German ambassador , which fully respects the sovereignty of this country and teaches us how we should work, that we are ready for a broad consensus", he said.

The Ambassador of Germany in Montenegro, Robert Weber, announced yesterday that the planned appointment procedure in the Prosecutor's Council, just before the summer break in the Parliament, jeopardizes the achievement of a wider two-thirds consensus for further appointments in the judiciary.

"For this reason, we support all the voices that are in favor of a process that leads to reaching a consensus," said Weber.

The head of the Delegation of the European Union (EU) in Montenegro, Oana Kristina Popa, called on political actors on Wednesday to put the interests of the citizens before the interests of the parties.

"Constructive dialogue is the way to the appointment of independent, politically neutral and expert members of the TS from among distinguished lawyers and NGOs. "Political majorities come and go, and investing in independent, politically neutral and expert institutions is a direct investment in a better quality of life for citizens and in the future of Montenegro in the EU," she wrote on Twitter.

Assembly: Session after the Board determines the proposals

To the question of "Vijesti", whether the parliament will vote on the new TS on Saturday, the Assembly answered that in order to consider and elect the members of that body at the plenum, it is necessary for the Committee for the Political System, Judiciary and Administration to reach the required level of agreement and determine the proposal of five candidates for TS members.

"You know that the parent board conducts a dialogue and implements an extremely efficient and transparent process. The session will be held when the heads of the clubs of the parliamentary majority inform the President of the Assembly that they have reached an agreement on the issues that will be the subject of the next session and the date of its holding, and for its holding it is also necessary that all parent committees that are in charge create formal assumptions that are in their jurisdiction", the Assembly states.
