Final stoppage in the works on the connection of Herceg Novi to the regional water supply system

The completion of the works on the project of connecting the municipality of Herceg Novi to the regional water supply system (RVS), as the only remaining municipality on the Montenegrin coast that is not yet directly connected to the Regional Water Supply System, after almost a year of delay, is finally certain, announced the director of the Regional Water Supply System. Josip Đurašković. At the meeting that Đurašković held with the owners of the company "Primorje" Hotel & restaurants AD Tivat, and in accordance with the expressed friendly attitude and aspirations of both parties to, in mutual interest and the desire not to endanger the public interest, reach a joint solution to the months-long dispute, successfully an Agreement was reached in the procedure for the payment of fair compensation for incomplete expropriation before the Administration for Cadastre and State Property PJ Tivat.

This ended the procedure according to the Decision of the Administration for Cadastre and State Property of PJ Tivat on the execution of incomplete expropriation, i.e. according to the appeal filed against this Decision by the owner of cadastral plot 71 KO Tivat, over whose land, in a length of about 35m, the route of the regional water supply on the PK Podkuk - Jadranska magistrala - Opatovo section passes, which was largely caused by hard and unyielding the position on this issue that was represented by the previous administration of the Regional Water Supply in mutual contacts with the owner of the land in question.

"After the successfully reached agreement and the signed Agreement, all the conditions have finally been met for the smooth continuation and completion of the suspended works on the Herceg Novi connection project, and thus for the completion of the construction of the first phase of the regional water supply system for the Montenegrin coast," Đurašković pointed out.

By the agreement signed with the owners of "Primorje" Hotel & restaurants AD Tivat, this company undertook to withdraw the appeal in question and agreed that on part of the mentioned plots 71/1 and 71/2 with an area of ​​64 m2, i.e. 30 m2, establish the authority for the installation and use of pipelines, fiber optic cable and supporting infrastructure in favor of DOO "Regionalni Vodovod Crnogorsko primorje" Budva, and provide unhindered access by motor vehicle and work machines or persons authorized by the Regional Waterworks.

In return, LLC "Regional Vodovod Crnogorsko Primorje" is obliged by this Agreement to, within 15 days from the date of conclusion of this Agreement, pay fair compensation for incomplete expropriation in the amount of 3.554 euros to the account of "Primorje" Hotel & restaurants AD Tivat, which was determined by the Decision of the Government of Montenegro on the determination of public interest for the incomplete expropriation of immovable property for the construction of the regional water supply system for the Montenegrin coast number 08-3099, dated 15.12.2016. year, and by the Ministry of Finance Certificate No. 07-9138/1 dated 13.6.2017. year, that the financial resources for the payment of compensation to the owner of the land were provided, and in accordance with the accepted report on the valuation of the immovable property prepared by a court expert and an authorized appraiser.

As the previous administration of the Regional Water Supply did not manage to reach an agreement with the representatives of "Primorje" and the PJ Tivat Cadastre Administration in the long term, this caused a halt in the works on connecting the municipality of Herceg Novi to the Regional Water Supply, which began in May 2020 and whose the completion date was 180 days, according to the contract with the contractor, the consortium "Indel Inženjering-Ramel-Civil Engineer" - Podgorica. The suspension of works caused damage to this state-owned enterprise on several grounds.

"Namely, the planned completion of the works would prevent potential additional costs to which, on this basis, and in accordance with the construction contract, the Contractor is entitled. In addition, the Regional Waterworks is hereby prevented from generating additional income during the summer season of 2021, when the municipality of Herceg Novi, if it had been directly connected to the RVS within the stipulated period, would certainly have had support from the regional water supply system and would not have faced water shortages and restrictions during the peak tourist season and the huge influx of tourists. In addition to direct damage, the unfinished "construction site "on the part of the Adriatic highway, the normal functioning and life of the residents of Tivat, as well as numerous guests, was greatly hampered".

"We would like to point out that the Regional Water Supply, through the project of connecting the municipality of Herceg Novi to the regional water supply system, will ensure the delivery of 200 l/s of high-quality water for the area of ​​the Herceg Novi Riviera, namely 130 l/s for the part from Sveta Neđelja to Zelenika, and an additional 70 l/s for part of the Luštica peninsula. The works include the construction of 3,2 km of new pipeline and optical infrastructure in the territory of the municipality of Tivat, which will connect the previously built part of the Regional Water Supply from the 80s to the system (about 9 km of pipeline in the territory of the municipality of Herceg Novi , the "Zelenika" reservoir, as well as the underwater pipeline to the Luštica peninsula). Financial support in the form of loans for the development projects of the Regional Water Supply, including this project, was provided by the EBRD, and the Regional Water Supply was in the previous period for the preparation and implementation of the connection project of the municipality of Herceg Novi also invested 400.000 euros of his own funds in RVS", the public relations service of the Regional Waterworks of the Montenegrin Coast announced.
