The Directorate for Inspection Affairs and Licensing of the Ministry of Ecology, Spatial Planning and Urbanism rejected the appeal of the Kotor company "Carinvest" and confirmed the decision of the Urban and Construction Inspection, which forbade the company of the Mayor of Budva, Marko Bata Carević, to build an auxiliary facility on state land in the village of Krimovica. 600 square meters.

"The appeal is rejected. The request for reimbursement of the costs of the procedure is rejected," the government department's decision reads.
As it is stated, the Urban Planning and Construction Inspection issued a decision prohibiting "Carinvest" from building "the object, AB structure, three floors above ground, dimensions basically around 30 x 20 meters, for the reason that it is being built without a construction report. It is about cadastral plot number 1140/1, KO Krimovice, which, according to the cadastral records, is owned by the state of Montenegro, that is, the Government of Montenegro.
In the list of immovable properties, which "Vijesti" had access to, it is stated that it is a pasture of class 4 with a total area of 351.394, on which the company Carinvest has built ten auxiliary buildings outside the economy, the area of which is 520, 681, 520, 343, 659, 268 , 313, 356, 214, 494 sq.
All auxiliary buildings are marked with the fact that the construction was started without a building permit, and that the construction is on someone else's land. It is the "Carinvest" farm, a complex of farms where goats, cows, pigs are raised...
After assuming the position of mayor of Budva in early January 2019, Tsarević left the position of executive director in the company "Carinvest" to his son Milan, while he is still listed in the central register of business entities as the founder of the company.
According to the document, Tsarević's company filed an appeal to the relevant ministry against the decision of the Urban Planning and Construction Inspection, stating that the inspection is not competent to act in this administrative matter, but the local self-government body, i.e. the municipality of Kotor.
"Because these are auxiliary facilities that are under the jurisdiction of the local self-government, and the inspection concluded that no works were carried out at the time of the inspection, which is why it is proposed to accept the appeal."
The Ministry of Ecology, Spatial Planning and Urbanism, as it is pointed out, considered the appeal decision, the appeal and the case files, and decided to reject it.
"From the file of the case, it was established that the Urban and Construction Inspection carried out an inspection on August 11, and that a building of AB construction, up to three floors above ground, was found on the ground, in the gray phase of the works, as well as building materials on the construction site. At the time of inspection, no construction works were being carried out. It was established that the inspection was attended by Milan Carević, executive director of "Carinvest", who stated that the company is an investor, as well as that it is an auxiliary facility, that is, a facility of general interest for rural development, and that it is responsible for it. local government. Also, the appointee stated that the object in question has been handed over to the competent cadastre for registration in the list, as well as that the procedure for further legalization will be entered into, the relevant ministry's decision states.
It is added that the inspection was also carried out on August 20, when "Carinvest" submitted a certified study of the recording and storey development of the auxiliary building in the private sector - no construction permit was submitted with the study, as well as that the building was built on someone else's land.
"Carinvest requested an additional deadline for supplementing the documentation, which was approved. A request for approval for a rural development facility — the "Carevic" agricultural farm — a livestock and poultry farm complex with a dairy and auxiliary facilities, filed in the Municipality of Kotor on August 17, 2021, as well as a conceptual design for a rural development facility, was submitted. As it is added, the Ministry assessed that the complaint that the Urban and Construction Inspection is not competent, but the local self-government, is groundless, referring to the decision that has yet to be made.
"Relations cannot be arranged with reference to a future and uncertain circumstance. From the file of the case, it was established and stated in the minutes, as well as in the list of immovable properties, that the object in question is located on the land owned by Montenegro, with the right of disposal by the Government of Montenegro. Bearing in mind the stated facts, i.e. that the facility is being built illegally on state land, the allegations of "Carinvest" that it is an auxiliary facility, that is, a facility of general interest for rural development, and that the local self-government is responsible for it, are unfounded. it is stated in the decision of the government department.

In February of last year, the Network for the Affirmation of the Non-Governmental Sector - MANS reported usurpation and illegal construction in Krimovica to the competent prosecutor's office, after which a case was filed before the Kotor prosecutor's office.
At the beginning of August, this non-governmental organization published videos, which "Vijesti" wrote about, showing that Tsarević's company, after the prosecutor's investigation began, continued to usurp state property, and that it built a business facility as well as a parking lot within the agricultural holding. an area of almost 10 thousand square meters on the other side.
Carevic recently said that MANS' accusations that he is illegally building on state land are "XNUMX% untrue" and an attempt to discredit him personally and politically.
"Everything that was done there was in accordance with the law and state procedures. Just today, I received a document from the urban planning of the Municipality of Kotor that everything was done in accordance with the Spatial Plan of that municipality, which was adopted in 2020", said the first man of Budva, but also denied that he is usurping half a million square meters of state property.
He pointed out that he has documents stating that, in addition to the location of his agricultural property, he received a permit for the expansion and use of state plots, as well as that in 2016 it was allowed to build auxiliary buildings on them.
