The Forestry Administration announced that, due to non-compliance with the provisions of the contractor's projects, and therefore breach of contractual obligations, they ordered the company "Pelengić Trade" from Bijelo Polje to temporarily suspend all work in the Economic Unit "Gornji Saranci", in departments 1a and 2a , in the Žabljak Regional Unit.
"Based on the proposal of Chief PJ Žabljak, Acting Director of the Forestry Administration, Srđan Pejović, M.Sc., ordered the aforementioned user to suspend all work in departments 1a and 2a in GJ 'Gornji Saranca' until the conditions for work are fulfilled, in accordance with the contractor's projects Namely, as the boss PJ Žabljak pointed out, the user of DOO Pelengić Trade, by signing the Agreement from September 2021 for the mentioned departments, was obliged to implement them in accordance with legal regulations, by-laws, and therefore in accordance with contractor's projects. Although the concessionaire respects the contractual obligations in the part of payment, realization of production in the felling and shipping phases, it does not respect the same in the part of the export of wood assortments from the forest to the truck road, in such a way that the work is not carried out in accordance with the contractor's projects. Chief PJ Žabljak pointed out is that the contractor's projects envisage a combined export, namely: by wagons to tractor trains, and then by tractor from the train to the truck road, but that the concessionaire and its subcontractors do not comply with these provisions," the announcement states.
They said that during a tour of the field, the district inspector noticed that the subcontractors were pulling wood assortments out of the tractor trains, which were properly marked on the field and in the contractor's projects.
"Even though this was pointed out to them, they continued to work on their own initiative and extract wood assortments without the use of carts and outside tractor trains, which the regional logger reported to the head PJ Žabljak. Considering that in these departments the number and density of young people is at a high level , the boss also sent a forestry engineer for forest use to the field so that he could also determine the factual situation. Based on the report from the field, the boss informed the Acting Director of the Forestry Administration that in order to consistently comply with contractual obligations, and therefore with contractor projects, it is necessary suspend further works, considering that PJ Žabljak will not tolerate such omissions by the users of the Žabljak forests," added the Administration.
They said that they hope that the forestry inspection, after visiting the field, will "truly establish the factual situation" and order the user to comply with all contractual obligations and provisions of the contractor's projects.
"Given that the Forestry Administration in the coming period strives to actively and without exception fight against all illegal activities in forestry, with special attention to respecting the contractual obligations of the users of state forests, the Acting Director of the Forestry Administration, Srđan Pejović, MA, emphasized that it will not be tolerated such and similar omissions and violations of legal acts and contractual obligations. In order to protect Montenegrin forests, we were obliged to order DOO 'Pelengić Trade' to suspend all work in the mentioned departments until further notice, according to the report of the head of PJ Žabljak, so that further irresponsible actions would not lead to in the end, to the violation of the provisions of the Agreement, on the basis of which the Forestry Administration can stop work or make a more difficult decision. We hope that the forestry inspection, after visiting the field, will truly determine the factual situation and order the user to comply with all contractual obligations and the provisions of the contractor's projects, and all with the aim of preventing unwanted consequences due to non-compliance with the aforementioned contractual obligations," the statement added.
Montenegrin forests can only be protected with persistence and consistency in monitoring, as well as compliance with contractual obligations by users of state forests, the Forestry Administration says.
"For these reasons, we will not tolerate even the slightest omission if we want to improve the condition of our forests, which is why we expect forest users to fully respect their contractual obligations," the announcement concludes.
