Thursday, February 17, by all accounts, will be the last day of the mandate of the Chief Special Prosecutor Milivoj Katnić, who, after six and a half years at the head of the Special State Prosecutor's Office, will be dismissed from his position by the decision of the Prosecutor's Council and sent to retirement.
This will end the era of a key man in the judiciary, whose work was accompanied by numerous accusations that he was the guardian of DPS interests and drawers, and because of whose dismissal, among other things, for more than a year, continuous work was being done on changes to the Law on the State Prosecutor's Office, as well as changes to the conditions for early retirement...
In addition to Katnić, as "Vijesti" has learned, the names of 11 other prosecutors are on the list for old-age pension - Sonja Bosković, Vesne Jovićević, Oliver Raznatović, Milivoje Tomčić, Radmile Ćuković, Suzana Milić, Ljiljana Milić, Milice Rmandic, Ferihe Muratović, Hajran Kalač i Božidarka Gačević, who, according to the amended conditions, exercised their right to retire.
Milivoje Katnić is not accepting the departure of GST calmly, but has written a letter to the acting director of the VDT Maja Jovanović, which he asked to "take certain measures, in order to prevent the independence and impartiality of the prosecutorial function from further collapsing", through the mechanisms given to her by the position.
In the letter, Katnić repeated, what he stated several times in public, that "the aim of passing the Law on Amendments and Amendments to the Law on the State Prosecutor's Office was exclusively his dismissal", and that because of this, as well as the amendment of the Labor Law, appealed to the Constitutional Court, which did not consider the initiative even after 8 months.
He emphasized that if the Supreme Court concludes that his mandate has been terminated because he has allegedly met the conditions for retirement, then he "unbearably violates the regulations", clarifying that the benefited work experience that he has acquired cannot at the same time constitute an imperative basis for the termination of the employment relationship or function earlier. than it is the case with other employees...
He asked the acting VDT to present his allegations from the letter, in accordance with the Rules of Procedure of the TS, to the members of that body, and to exclude two members of the Prosecutor's Council before deciding on his mandate due to suspicion of impartiality. Siniša Gazivoda i Steva Muk.
"Gazivodu and... Stevo Muk, who during the public hearing, in connection with the drafts of the prosecutor's laws, at the words of the then Acting VDT Ivica Stanković, which outlined the reality that changes to those laws are being passed solely for the sake of my elimination, stated: So what, even if it's personal, he deserves it because he doesn't respond to the calls of the Assembly and parliamentary bodies and non-governmental organizations, and if he does respond, he says what he likes,'' Katnić wrote.
At yesterday's session, members of the TS agreed to continue the session on Thursday at 15 pm, where they will state the termination of office for the prosecutors, who have exercised the right to retirement. TS obliged the Secretariat of the Prosecutorial Council to obtain data from the PIO Fund for all prosecutors over the age of 60 by then, and to receive notifications from the heads of prosecutions about prosecutors who have reached the conditions for retirement by then.
That the issue of leaving office, due to exercising the right to an old-age pension, should be brought to the attention of the TS as soon as possible was initially raised by a representative of the Ministry of Justice Andrej Milović, who demanded that the declaration of termination of office on that basis be immediately included in the agenda.
The acting VDT officer said that, after five working days in that position, she does not have available documentation and that, therefore, the conditions have not yet been met to discuss it. She suggested that a reasonable deadline for that question would be seven days, and the prosecutor agreed with her Đurđina Ivanovic, who repeated several times that she is not opposed to TS dealing with the issue of old-age pensions, but to leave a deadline for obtaining documentation of 7 days.
"We are left with a burden from an earlier period. "We need to send a request to the PIO Fund today, in which we are asking for data on prosecutors who are over 60 years old, so I see no reason to stop, let's continue the session tomorrow," said Gazivoda.
Jovanović emphasized that she "doesn't run away from it, but that the documentation must be prepared and that everyone should be given time to familiarize themselves with the data."
"Here, the chief special prosecutor spoke about that issue today, let's give it time," said Jovanović, after which she suggested that they continue the session on Thursday afternoon and deal with that issue.
Boričić wrote to TS: The manager brutally broke the law
The Prosecutor's Council noted yesterday the evaluations, which the former TS made at an electronic session on July 27 last year, which determined the evaluations of the program work of two candidates who applied for the repeated TS advertisement - on June 22, 2021 for position of manager of ODT Podgorica.
A prosecutor from Podgorica is in the race for the key position of the largest prosecutor's office Nikola Boricic and head of ODT Cetinje Dusko Milanović.
At the end of last week, Boričić informed all TS members that she is the head of the Higher State Prosecutor's Office Beautiful Medenica - contrary to Article 137 paragraph 3 of the Law on the State Prosecutor's Office, on December 24, 2021, by which she designated the prosecutor Armin Selmanović for the deputy of the ODT Podgorica, without the session and voting of the prosecutors of the ODT Podgorica, and based on the conclusion of the extended session of the Supreme State Prosecutor's Office.
"In the practice so far, it is unheard of for the deputy head of the ODT to be elected, without the session of the prosecutor's office declaring about it beforehand. In this way, the head of the Higher State Prosecutor's Office brutally violated the provision of Article 137 paragraph 3 of the Law on the State Prosecutor's Office, which she is aware of, because it is more than clear that only the prosecutors of the prosecutor's office in which the deputy head is elected must declare their opinion on the election of the deputy head." Boricic stated.
Almost a year before that, he held the position of deputy head of ODT Podgorica.
The disciplinary prosecutor and the deputy will be known on Thursday
At the TS session yesterday, the disciplinary prosecutor and his deputy were not elected because the Minister of Justice, Human and Minority Rights, that is, the manager and the Prime Minister Zdravko Krivokapic he did not submit his proposals.
Prosecutors Danka Ivanović Djerić i Tanja Nišavić were proposed at the session of the Supreme State Prosecutor's Office for the performance of these tasks, and it seems that the representative of the Ministry of Justice liked the proposal of the prosecutor's organization.
"I looked at the proposed names this morning. Although I believe that they are professionals, I believe that we should move that item on the agenda and make a decision," said Milović, who asked if there was an obstacle for the Ministry of Justice to perhaps propose the same names for disciplinary prosecutor and deputy.
