Many Podgorica schools recently received requests for free access to information from lawyers Dejan Klikovac, attorney E. M, requesting the payroll of certain employees for 2020 and 2021, which caused an uproar considering that they do not know the person, according to whose order her attorney is requesting information.
The school trade union organizations claim that they do not know why anyone would ask for this, especially if it is about, as they point out, a person who has never worked in those institutions.
They point out that colleagues are revolted because of this, and school administrations are overwhelmed because it is about 24 special solutions for everyone for whom the pay slips are requested.
Lawyer Klikovac said that the requests were submitted, that the procedure was followed in accordance with the Law on Free Access to Information.
When asked if there are any proceedings against school employees, given that they do not know the person they represent, Klikovac replied that it is about "information that is between me and the client".
"...Well, I wouldn't reveal that to you," he said.
According to him, it is incorrect that the school administrations are busy and do not manage to send the requested data within the legal deadline.
"Most have already done it. They responded to our every request. Some refused to give access to information, which is why a further procedure will follow, but absolutely every request was answered", said Klikovac.
The Ministry of Education, Science, Culture and Sports said that school administrations informed them of this case.
"Our recommendation is to respond to every request for free access to information within the legal deadlines, taking care to preserve the personal data of colleagues", told "Vijesta" from MPNKS.
The Education Union is also aware of the requests that schools received at the beginning of the month.
"We know that a certain person, through a proxy, is asking for information about his colleagues, and why he needs it - we don't know. If we knew the motive and the goal, as a trade union we would do our best to help additionally", the president of the trade union for education said in a statement to "Vijesti". Radomir Božović.
He also believes that this is a big blow to the institutions' administrations, because a separate decision should be made for each month.
"Also, services must protect the personal data of colleagues. It is literally burying the school administrations," says Božović.
According to a member of the Council for the Protection of Personal Data and Free Access to Information Muhamed Gjokaj, schools are bound by the SPI Act.
"Persons whose data is processed can submit a request for the protection of personal data rights and the extent to which personal information is protected or unprotected on the payment solutions for free access to information," said Gjokaj to "Vijesta".
