Putting up Marko Begović for the acting director of the Directorate for Sports and Youth represents a threat to the public interest in terms of the Law on Prevention of Corruption and may affect the integrity of the Directorate, i.e. now the Ministry of Sports and Youth and the Government, the Agency for the Prevention of Corruption found.
Commenting on the opinion of the Agency, Begović said that in November of last year, the administrative inspector found that it met the conditions, that is, that no irregularities were found.
"Everything else that happened, including the adoption of several additions to the previous decision, represents illegal activity, bearing in mind the norm cited in Article 64 of the Law on Administrative Procedure, which stipulates that 'nothing may be added or changed in the signed and concluded minutes'". Begovic said.
In January, based on information from the media, the agency initiated a procedure to determine the existence of a threat to the public interest of the then Minister of Education, Science, Culture and Sports. Vesne Bratic, on whose proposal the Government appointed Begović as director of the Administration.
According to media reports, Begović was appointed as the director of the Administration even though he does not meet the requirements for that position provided by the Rulebook on the internal organization and systematization of workplaces. The then Ministry said that it met all the conditions.
"By examining the documentation obtained by the Agency in its official capacity, and the records of the inspection carried out by the competent administrative inspection that assessed the fulfillment of the conditions for appointing Begović as director of the Administration, and the statements of the Ministry, it indisputably follows that the authorities that were competent to appoint Begović for the acting director at no time during the entire procedure did not check the facts, whether the appointed person really had the required five years of work experience in the VII/1 degree of professional education", states the opinion signed by the director of the Agency Jelena Perović.
Perović states that the authorities relied only on the certificate issued by "PRO-LOG CG", a company that no longer exists in the records of the Central Register of Business Entities.
In relation to their confirmation, the Agency further states that even the Directorate of Inspections could not state with certainty, but stated "that there is no evidence on the basis of which it would be reliably established that Begović meets the requirements for the acting director of the Directorate, in terms of the necessary work experience". .
It follows from the case file that the competent administrative inspection, during the first term in acting status, determined that he did not meet the requirements in terms of the necessary work experience, so that after that, at the proposal of the then minister Bratić, a decision was again made to designate Begović as acting director. at the end of March.
"Given that at that time all actors who participated in the process of determining the appointed acting director of the Administration had to be familiar with the factual situation established by the competent inspection, it remains unclear for what reason they did not carry out a verification of the fulfillment of the requirements for Begović for the position in question", he adds. in the opinion of the director of the Perović Agency.
In the end, the Agency gave a recommendation to the Ministry and the Government that "in all future cases related to the procedures for proposing nominations, appointing an acting director, appointing and dismissing a director, they should carry out a preliminary procedure for verifying the fulfillment of the candidate's conditions and consistently comply with positive legal regulations in a way that does not arouse suspicion into the existence of corruption risks and does not call into question the integrity of institutions".
Begović said that he has more than 13 years of work experience, over seven of which in decision-making positions.

Begović stated that the operation of the inspection coincides with the process of cleaning the Sports and Youth Administration and the sports system from corruption, which, he points out, should have been the job of the Agency for the Prevention of Corruption.
"Then, in cooperation with a small number of colleagues, those who received housing loans in the amount of more than 30.000 euros, as well as those who distributed millions of euros from Montenegrin citizens through the budget reserve and conclusions to related legal entities in sports, were stopped. That is the only problem here," he said in a statement to "Vijesta".
He added that he filed a criminal complaint in August. "Because I believe that it is an organized group, i.e. on connected persons in several state administration bodies. Of course, I also included the Agency in my application," he said.
