Prava Montenegro announced that it has submitted an amendment preventing abuses by managers of residential buildings.
"The current Law on the maintenance of residential buildings leaves a lot of room for abuse of the function of managers of residential buildings, because the managers have the obligation to send the report on the use of maintenance funds only to the Assembly of apartment owners", according to the statement of the Law of Montenegro.
They said that in practice it is abused in such a way that only some of the reports are sent to the president of the Assembly of Condominium Owners or are selectively published on the notice board in the entrance.
In this way, as they state, many important information about the maintenance of the building are not published on the notice board, so that apartment owners often do not know how the funds, which are paid into the common account of the apartment building, are spent.
"In this way, space is left for the managers of residential buildings to non-transparently spend the funds of apartment owners through the joint account of the residential building," said the party.
According to them, the amendment to that law enables all apartment owners to be informed about important issues related to building entrance maintenance.
This, they add, is made possible by establishing the manager's obligation to send written reports to all apartment owners about regular maintenance works of a larger scale, necessary and urgent works on a residential building within 30 days from the date of completion of the works, as well as an annual report.
"Written reports on the works on the residential building are important, because all apartment owners have the right to be informed in writing, how the funds of the residential building are spent," they said.
They point out that it is especially important for condominium owners to receive written reports on the works on the building so that they can use them as written evidence of the damage caused in the event that the works cause damage to their special parts.
As they state, in that case, those reports could be used as evidence in the procedure for compensation of damages before the competent authorities.
"Prava Montenegro with this amendment contributes to the protection of the rights of condominium owners, by stopping the arbitrariness and abuse of the managers of residential buildings. In this way, more order and transparency is introduced in the area of management of residential buildings," the party concludes.
