The Social Democratic Party requested today to withdraw from the parliamentary procedure the Draft Law on Spatial Planning and Construction of Buildings, judging that this act violates the Constitution, the Law on Local Self-Government, international documents and ignores municipalities.
MP Draginja Vuksanović said at the press conference that this scandalous act was "a tycoon's attack on space as the most valuable state resource".
"This proposal clearly violates constitutional principles, the Law on Local Self-Government as a systemic act, the European Charter on Local Self-Government and the fundamental European principle of decentralization," Vuksanović assessed.
She believes that the proposed law ignores municipalities, excludes them from the active spatial planning process.
"This ignores the citizens of all Montenegrin municipalities who, through their representatives, ask almost nothing about perhaps the most important issue that is important for their life in the local community - the issue of spatial planning," said Vuksanović.
She assessed that with this law the Government wants to sacrifice its own legal system, the accepted rules and principles of the European Union and the Council of Europe. "With this law, the government ignores and ignores the profession, professional associations, the views of municipalities, the civil sector, the opposition, and international organizations."
"Because in order to satisfy the greed of the DPS tycoons who have little stock of material goods in Montenegro, they want more, now they are aiming for the space that they have not yet finished and stuffed into their overflowing pockets," said Vuksanović.
She warned that, contrary to the legal system and common sense, authorities in the field of spatial planning are being taken from municipalities and given to a single center.
"And imagine that to which center?! To the ministry that is most responsible for the total devastation of the area, for the urbicide and destruction of Montenegrin cities, especially the coast. The ministry that, according to the current regulations, had clear legal instruments to prevent the devastation of the area, but all this was done at the persuasion of the DPS powerful and tycoon," said Vuksanović.
The president of the Kolašin municipality, Željka Vuksanović, assessed that such a law weakens the powers of local self-government in spatial planning, and all in favor, as she said, of tycoons close to the authorities.
"The Government's intention to abolish the right of local self-governments to adopt spatial plans with the new Law is in direct contradiction to the Law on Local Self-Government," she believes.
