The night club sued the Municipality of Budva for lost profits, asking to be paid for turning off the music

The fight against noise, which was implemented at the end of August by the Municipal Police and the Inspectorate with the support of the new municipal leadership, by banning the performance of music in two popular discotheques on the promenade in Budva, has now come to fruition - the Budva company Teatro plus DSG, which runs a discotheque on the promenade at Slovenska beach, as "News" confirmed in the Secretariat for Property Protection, she filed a lawsuit in the Basic Court in Kotor against the Municipality of Budva - Municipal Police and Inspection.

As written in the lawsuit, the Municipality is requested to pay compensation for material damage - loss of profits for the period from August 23 to 28 last year due to, as they claim, the illegal ban on broadcasting music through electroacoustic and acoustic devices.

The amount of damage suffered by this restaurateur, as stated, will be specified during the procedure after the presentation of evidence.

"On August 23, 2022, the plaintiff (Teatro plus DSG), which performs economic activity, was prohibited from broadcasting music. Acting inspection body of the local self-government issued a decision banning the broadcasting of music through electro-acoustic and acoustic devices. The municipal police and the municipal inspection did not establish the relevant facts, properly applied the current regulations, that is, they did not previously carry out the prescribed procedure in which it would be determined in the manner prescribed by law whether there were any irregularities, so that only then could the application of measures banning the broadcasting of music be considered. Therefore, the body of the Municipality of Budva - Communal Inspection and Communal Police made an illegal decision without any factual and proper basis, acting with obvious intent or gross negligence. The business entity in the catering facility has a properly installed sound limiter, which has been functioning properly since the beginning of work until today, as well as at the time of the illegal actions of the Municipal Police," the lawsuit states.

As they claim, they were harmed by such actions of the Communal Police.

"Due to the illegal measure banning the broadcasting of music, the citizens who intended to be guests in the restaurant immediately left it. Due to the disputed illegal measure that was valid from August 23 to 28, Teatro plus DSG did not operate, i.e. due to the ban on broadcasting music, guests did not stay in the catering facility, as they did before the imposition of this measure. It is obvious and obvious that the illegal ban on music broadcasting has affected the volume of business," the lawsuit states.

The imposition of a measure banning the performance of music for two popular discotheques on August 23 caused a protest by the workers not only of those, but also of the surrounding catering establishments - popular open bars and discotheques. Namely, employees of nightclubs in Budva blocked the city's main boulevard and roundabout for 20 minutes that evening, which caused a traffic collapse at a time when there were thousands of tourists in Budva.

The action was carried out after the new chief of the Municipal Police and Inspection was appointed, and the green light to restore order in the city was given by the newly appointed president of the Municipality of Budva. Milo Bozovic.

The communal police made the decision to turn off their music after two complaints about excessive noise that they made to the discotheques in the past two days.

Bars were allowed to operate, but they were not allowed to play music.

The problem of noise was pointed out by representatives and citizens of the local communities of Stari grad and Gospoština, who launched an initiative to suppress noise last summer.

The city administration has announced that during the coming summer the noise problem will be completely suppressed, and that legal measures will be implemented against anyone, indiscriminately, who broadcasts music above the legally prescribed level in their premises.
