As he explained, the DUP "Nova varoš 2" and the urban-technical conditions issued by the Secretariat for Planning, Spatial Planning and Environmental Protection of the Capital City of Podgorica prescribe the distance of the building to the regulatory line of three meters, and to the neighboring plots of land two meters. In addition, he said, the possibility is left that the construction line of the underground floor can be a meter from the neighboring plot, or at a smaller distance, with the prior consent of the neighbors.

"By a wrong interpretation, this last provision was also used for the underground building line towards the street, which is not considered a neighboring plot, but a public area bordering the plot by a regulation line. Therefore, the consent submitted by the investor and at the same time the owner of the cadastral plots 2325/2 and 2326/2 KO Podgorica, on which there is a part of the public road, that he agrees that by moving the underground construction line to a smaller distance of one meter towards the street is not relevant in in this particular case, the distance from the regulation line had to be in accordance with the graphic attachment from the planning document", explained Mitrović.

At the same time, as he said, the traffic connection on the eastern side of the plot is disputed, "bearing in mind that the traffic connection is provided on the western side of the plot by urban planning and technical conditions."

"Because of the above, we believe that the consent of the chief state architect on the Conceptual Solution was not issued in accordance with the planning documentation and urban planning and technical conditions," Mitrović said.

As he said, the professional chamber of architects is also of the opinion that in the specific case for the disputed plot "it is a bad planning solution, bearing in mind that the planned facility and traffic solution deviates from the urban matrix of this part of Nova Varoš".

The chief city architect re-examined the planning document DUP 'Nova varoš 2', and found that the cadastral plots in question are not construction plots, but are located within the reach of the public road, and by examining the Real Estate List 3973 - copy, it was found that the expropriation procedure was recorded in favor of of the capital city of Podgorica for the purpose of reconstruction of the traffic road towards the Small Sports Stadium, in the scope of the DUP 'Nova varoš 2'", stated in Aleksić's decision.

It is also added that the investor then submitted an amended conceptual solution, but that the chief city architect's remarks regarding the projected dimensions of the basement floor were still not acted upon.

"Among other things, the statement states that 'if the authority still considers, without reason, that the consent of the neighbors is not sufficient, the investor will have no other option but to change the basement part and the position and foundation of the building itself, which would be to the detriment of the trees. which are several decades old'. Considering the investor's allegations, the chief city architect concluded that even though the decades-old trees are located on a private plot, he cannot give a positive opinion on their removal... he informed the investor about this...", it is written in the decision by which Aleksić refused to give consent to the conceptual design of the "Okova" building.

At its session on Friday, the Government adopted the Proposal for a Decision on the Development of Amendments to the Detailed Urban Plan "Nova varoš 2" in the Capital City of Podgorica, as well as the Proposal for a Decision on Designating the Manager of the Development of the Amendments to the DUP "Nova varoš 2" and the amount of compensation for the manager and expert the team for creating that document.
