Tenants of the part of Beogradska Street in Podgorica, where the plan is to build a residential building of over 4.300 square meters, demanded the immediate cancellation of the consent by which the Chief State Architect allowed the company "CK Group Investment" to build.

They said this today at a protest over the construction of a four-story building in the Beogradska area. As one of the arguments against further construction, they referred to the opinion of the Chamber of Engineers, which gave a negative comment on the conceptual solution for the residential building of the company "CK Group Investment".

The Chamber assessed that it was not done in accordance with the urban-technical conditions and the valid Detailed Urban Plan "Gorica C", in the part that refers to the maximum number of floors and the association of plots.

The Podgorica company "CK Group" for the construction of a building of over 4.300 square meters received the consent of the Chief State Architect of the company in mid-June last year. The construction was reported to the urban-building inspection of the Ministry of Ecology, Spatial Planning and Urbanism on November 10. The building is being built on urban plots 2b.19 (KP 2532/2 and 2531/1) 2b.20 (KP 2532/1), Block 2, sub-block b, in the scope of DUP "Gorica C", KO Podgorica II.

Tenants previously said that, according to the DUP from 2005, two family residential buildings were planned here. In 2019, a new DUP was drawn up, which the tenants claim is "beyond the law", which is why they demanded that it be repealed.

"In the graphic part of the DUP ‚Gorica C', as well as in the graphic part of the issued urban planning and technical conditions for the mentioned plots, the maximum number of floors Po+P+2+Pk is stated. In the textual part of this plan, and the urban planning and technical conditions in one chapter states that the maximum number of floors in block b is up to Su+P+3+Pk. The stated statement does not refer to the mentioned plots 2b19 and 2b20, but to the maximum number of floors at the level of the entire block, and to the plots that are specified in the graphic part of the plan Due to a misinterpretation, this provision was also used for plots 2b19 and 2b20, so the conceptual solution exceeded the permitted floor height," writes Novica Mitrović, president of the Professional Chamber of Architects, in the response to the Tenants' Initiative.

It is added that the Chamber is also of the opinion that combining a part of an urban plot with another urban plot, as was done in the conceptual solution, "is not in accordance with the textual part of the planning document that refers to the rules of subdivision".

The Chamber's response was submitted by the tenants to the Ministry of Ecology, Spatial Planning and Urbanism. Chief state architect Vladan Stevović, who succeeded Mirko Zićić in that position in October 2022, said that his department should make a decision on the investment in Beogradska 51 within the next week.

Tenants also protested last month due to the start of construction work on a building of over 4.300 square meters.

During the night of February 26 and 27, part of the yard collapsed as a result of work on the construction site, on the neighboring plot, where the Vukčević family's house is located. In the meantime, the inspection ordered rehabilitation, but the tenant's representative, Srđan Laković, said today that "it is not about rehabilitation, but about the continuation of the work".

Lidija Vukčević, the owner of the house whose part of the yard collapsed due to the works on the neighboring lot, said that since February 27, she and her family have not been sleeping or staying upstairs, but have moved their lives to the room they use as a summer kitchen.

At the end of January, the Chamber of Engineers also negatively evaluated the conceptual design of the facility, which the company "Okov" is building in Beogradska Street, within the "Nova Varoš 2" DUP. As they told "Vijesta" at the time, that conceptual solution was not fully completed in accordance with the issued urban planning and technical conditions. They also said that the consent of the Chief State Architect to that conceptual solution is not in accordance with the urban-technical conditions and planning documentation.

The urban planning and construction inspection then sealed the construction site.

At that time, the department of the minister in the technical mandate, Ana Novaković Đurović, did not answer the question of whether the negative assessment of the Chamber of Engineers on the approval issued by the office of the chief state architect entails his responsibility, that is, the responsibility of the person who signed the decision. They also did not answer whether the investor can claim compensation for damages due to the ban on construction, because he built on the basis of the decision issued by the department that also banned the construction.
