DOO "Regional water supply of the Montenegrin coast" has been facing the problem of paying special compensation for a long time by a significant number of entities that built facilities on the Montenegrin coast without building and use permits.
This was announced by this state-owned company.
"Regional undertakes a series of activities in order to control the issued construction permits, with the aim of checking whether the buildings have been built, that is, put into use with the prior acquisition of the complete necessary documentation," the announcement states.
As announced by the Regional Waterworks, the obligation of all investors is to pay a special fee for investments defined by the Law on Regional Water Supply of the Montenegrin Littoral during the construction or reconstruction of facilities on the territory of the municipalities of the Montenegrin Littoral, of which 80% belongs to this Company, while the remaining 20% belongs to the municipality on whose territory the investment is being realized.
In the period from 2008 to 2011, as they stated, according to the then-current Law on Spatial Planning and Construction of Buildings, payment of the fee in question was not a condition for issuing a building permit, but it was the investor's obligation to pay the fee before using the facility, i.e. in the phase of obtaining a use permit.
"Therefore, the investor's obligation for facilities for which building permits were issued in the period from 2009 to 2011 in terms of payment of a special fee does not exist until the moment of submitting the application for the issuance of a use permit, and the use of facilities without previously issued use permits is subject to control and taking measures by other authorities, which our Society has repeatedly pointed out," said the Regional Waterworks.
They added that on April 15, 2014, a Protocol on Cooperation was concluded with the Administration for Inspection Affairs, in which, among other things, it was defined that the Administration for Inspection Affairs will carry out the inspection of facilities on the Montenegrin coast built without a building permit, i.e. put into use without a use permit. permits", emphasizes the Regional Waterworks.
After visiting the field, the Directorate for Inspection made reports on the status of the constructed facilities.
"In the reports, he stated that most of the buildings were not used for their purpose, but there were also cases of the use of the building without a previously issued use permit. However, the Regional Water Supply has not been informed about the specific measures taken against those persons," said the Regional Water Supply.
We note that the Regional Waterworks, they say, recognized this potential problem in avoiding payment of a special fee for buildings for which building permits were issued without a previously paid fee, and actively participated in the drafting of the new Law on Spatial Planning and Building Construction, which was adopted in 2017.
Then, at the initiative of the Regional Waterworks, the statement added, an additional provision was included in Article 227 that refers to these facilities and the obligation to pay a fee when issuing a use permit.
"Taking into account the financial challenges that the Regional Water Supply is facing, as well as the estimated amount of the special fee that should come in, the Regional Water Supply appeals to the competent entities to solve this problem as soon as possible", concludes the announcement of the Regional Water Supply.
