The Secretariat for Property Protection of the Municipality of Budva once again sent an urgent letter to the Minister of Ecology, Spatial Planning and Urbanism Ani Novaković Đurović, demanding that she provide them with written information about what was done with the cancellation of the construction application of the company "Mia Invenstment", which plans to build two towers in front of the Adriatic Fair hall, about twenty meters from Slovenska beach.
The secretariat sent the emergency to Novaković Đurović back in October of last year, warning her that the Municipality had a problem with the Urban and Construction Inspection. The latest urgency came after the Budva company "Mia investments", which brings together Turkish businessmen, started cleaning a large plot of 8.500 square meters and thus announced the construction of a 5-star hotel-apartment complex "Mia Budva", consisting of two towers of 15 and 16 floors.
Turkish businessmen practically got the green light, after the owner of the plot, the company "Safiro beach resort", settled a debt of millions to the Novi Sad company "Carinvest RS", owned by the family of the former mayor of Budva. Marko Tsarević.
The company "Safiro beach resort" from Podgorica, the owner of an attractive plot, the only undeveloped one next to the Slovenska beach itself, paid 4,3 million euros of the credit claim that Tsarević's company bought from the bank.
In August 2018, the Turkish company and "Safiro beach resort" concluded an agreement on the joint construction of the "Mia Budva" complex.
"As we urgently informed you in writing on October 14, 2022, about the problem we have with the Urban and Construction Inspection, which concerns the protection of the interests of the Municipality and the municipal property we own on urban plot 26.1 in block 26, and within the Detailed Urban Plan (DUP ) "Budva center", the investor "Mia investment", now we are forced to urge you again to provide us with a written notification about the activities undertaken with the aim of canceling the approved construction application", says the letter signed by the secretary for property protection Đorđe Zenović, which "Vijesti" had an insight into.
Zenović reminded the minister that at the meeting held on December 6 last year, they discussed, among other things, "the construction report and the problematic (in)actions of the Urban Planning and Construction Inspection, which did not provide the requested answers to several letters and requests from the Secretariat for Property Protection for the circumstances of granting construction approval".
As he added, the position of the municipal secretariat is that the building permit was issued contrary to the law and the procedures established by the law.
"Once again, we remind you that we are the Urban and Construction Inspection and your predecessor, Mr Ratko Mitrović, submitted the judgment of the Administrative Court dated May 10, 2021, which annulled the decision of the Ministry of Sustainable Development and Tourism dated December 15, 2019, which refers to the approval of the preliminary design for the construction of buildings on the mentioned urban plots, and that we believe that the submitted application for construction does not may remain in effect. In addition, there is another dispute before the Administrative Court in which we challenged the decision of the Ministry, so we believe that the possible start of construction at the moment when we expect a verdict in favor of the Municipality represents a gross violation of the public interest, which is the protection of the interests of all citizens of Budva," stressed Zenović. .
He warned that the possible start of construction at that location would cause irreparable damage to the interests of the Municipality, which were established by the DUP, which provided for the construction of a congress center at the specific location and within the center of the congress hotel.
"It was precisely the intention that the built congress hotel would function as a congress center, which would complete the tourist offer of Budva. If it becomes impossible for the Municipality to protect its interests, which are reflected in the fact that we own a significant area of the cadastral plot on the specific urban plot, as well as that for the purposes of building the planned contents for the needs of the congress center, we formed a joint venture "Expo Budva" with the Adriatic Fair, this will have far-reaching consequences not only for the attractive area where the plot is located, but also for the city of Budva and for Montenegro. "We sincerely believe that this is not the intention of the ministry you lead, so we expect that this time you will provide us with information on the steps taken and all accompanying documentation on the steps taken," Zenović said.
The construction board on the plot in front of the fair halls was placed on the eve of last summer, when it was announced that the construction of the first of the two towers, a 15-story hotel, would be completed by May 2025.
As "Vijesti" confirmed, Turkish investors will start cleaning the plot and preparatory work these days, but construction will only start in October, because the ban on construction works for the exclusive and first construction zone of the metropolis of tourism will come into force on May 15 and will last until May 1. October.
The minister confirmed that the Turkish investors' construction application was legal in September of last year, stating that an inspection of the Ministry's archives revealed that the investor "Mia investments" submitted the construction application on May 27, 2020, and in accordance with Article 91 of the Law on Spatial Planning and construction of the building, it was recorded in the minutes that the investor had acquired the condition for construction.
The project was approved in March last year by the Directorate of the Chief State Architect (GDA), which he then managed Mirko Žižić, and the project itself is worth 70 million euros.
According to an earlier announcement from "MIA investment", they are building a five-star hotel on this land, with 144 standard hotel rooms and 208 hotel suites.
