The first phase of the MR1 access road for the Luštica Bay tourist complex in Krtoli near Tivat, not even more than five years after it was built, has not been technically accepted or issued a use permit.
Despite this, the road has been used smoothly for years, but in the event of an accident with serious consequences, the Municipality of Tivat as an investor and construction contractor, the company "Toškovići" from Podgorica, could face lawsuits with high damages requirements.
The Directorate for Investments of the Municipality of Tivat has confirmed to "News" that the first phase of MR1 has not been formally completed, nor received.
"The construction of road MR1 (Phase I), where the contractor was the company 'Toškovići' doo from Podgorica, and the expert supervision was carried out by the company 'Civil engineer' doo from Podgorica, has not yet been technically accepted. It is necessary to renew the vertical traffic signals on the route of the road, to install the missing public lighting poles, to finish the works on the construction of banks and berms", the Directorate led by the Acting Director told "Vijesta" Vlado Brguljan.
He said that in the past period, meetings were organized with the contractor, the company "Toškovići", where all the necessary works were agreed upon, as well as the documentation that needs to be submitted in order to carry out the technical acceptance of that part of the road.
"Nevertheless, despite several requests from the investor, the contractor has not fulfilled his obligations to date," said Brguljan.
According to him, the situation is completely different with the second phase of the MR 1 road, which was built by the company "Bemax" from Podgorica, and the expert supervision was carried out by the company GPC from Podgorica. That part of the road has been technically accepted, and all recorded defects have been eliminated in time.
"Requests were submitted within the warranty period for the elimination of defects in the public lighting installations on that phase of the MR1 interchange, which were eliminated," Brguljan said.
Besides, while driving the car, you notice the difference in the quality of the undercarriage and the asphalt covering of the road when you go from the perfectly flat second phase of MR1 made by "Bemax" to the significantly bumpier first phase of that road made by "Toškovići", the first phase of MR1 is in a catastrophic condition as far as the vertical traffic signals and the part of the public lighting poles installed along the road are concerned.
The construction of that phase of the MR1 road, according to the contract concluded with "Tošković" in 2016, cost the Municipality a little over 2,5 million euros.
By the way, the company "Toškovići" received a lawsuit before the Commercial Court in Podgorica in November last year against the Municipality, which the company sued because it allegedly owed it a little over 80.000 euros for an unpaid construction situation from the construction of the first phase of MR1, from 2018. It is about "Temporary Situation 13" which refers to exactly what the Municipality, as an investor, complains about Tošković even today - vertical traffic signals, banks, protective wire nets on the ground next to the road, humus on the green areas on the dividing islands, etc.
The Municipality appealed against this verdict and that procedure is still ongoing.
The company "Bemax" said that the work for the construction of the second phase of the MR1 road, worth 2,97 million euros, was contracted with the Municipality of Tivat in October 2018 and completed on time in August 2019.
"According to the provisions of the contract, the guarantee for the quality of the works that affect the safety and stability of the building is ten years, while for other works the guarantee is for two years, which means that the guarantee period for works on vertical signage has expired", they announced from "Bemax", noting that "the supplier of vertical signaling signs had all the necessary documentation in accordance with the contract and standards for this type of work".
They thanked "Vijesti" for pointing out that in the meantime the traffic signs they had installed on the second phase of the MR1 road showed signs of unusually high wear and tear and that they were burdened or lost their signaling properties, albeit to a lesser extent than those signs that "Toškovići" had previously installed on "their" part of the MR1 road.
"Our representatives will visit the location of the road where Bemax was performing the work and determine if there are any defects on the mentioned signs on that part. If it is determined that there is, we will immediately get in touch with the supplier of the signs to correct all the defects, i.e. replaced all necessary characters. If the supplier does not do so within the next seven days, the company 'Bemax' will at its own expense replace all the signs that have suffered due to the influence of weather conditions. Although the warranty period for the works has expired, we believe that it is right that the signs are still correct and in a functional state", informed "Vijesta" from "Bemax".
Signaling destroyed and unusable, the company contacted the manufacturer
Traffic signs installed by the company "Toškovići" are in a particularly bad condition, and almost all of them are destroyed and unusable after only five years. The paint on them has fallen off, the symbols have been erased or they have come off from the tin base of the sign, they have lost their refraction properties, or they have already corroded noticeably.
The company Toškovići told "Vijesta" that the manufacturer and supplier of the traffic signs that they installed on the first phase of the MR1 road in Tivat was the company "Hex" doo from Podgiorica.
They also followed the invoice from January 31, 2018, for which they paid 70 euros including VAT for a total of 4.368 pieces of various traffic signs and signs delivered to them by that company. A certificate issued by "Guardian Independent Certification" from Great Britain was also submitted, which confirms that the Chinese company "Fujian XinLi Yuan Reflective Material Co Ltd" meets the quality standard ISO 90001:2008 when it comes to the production and servicing of reflective materials used in the production of traffic signs. of signs, which were also used on the signs delivered in 2018 by "Hex" doo from Podgorica.
"In a telephone conversation with the executive director of 'Hex', we were told that the signs in question have a five-year shelf life and that, if necessary, he is willing to react and make the necessary corrections." it was announced to "Vijesta" from the company "Toškovići".
