There was a job in Podgorica's "Čistoča", but not for Hota

The executive director of "Čistoće" said that since the beginning of the year, he had employed five people, but not the former employee, who should have been reinstated according to the court's ruling.

Since the beginning of the year, "Čistoća" from Podgorica needed staff with a technical degree, but they did not return the mechanical engineer to work. Denis Hota, because at the time when he asked his former employer to return to work, those positions were already filled.

This is stated, among other things, in the executive director's statement Andrija Čađenović (DPS), which, at their request, he submitted to the Board of Directors on June 9.

President of the Board of Directors Milan Vukadinović (Democrats) asked Čađenović to provide data on whether persons with VII 1 level of education had been employed in "Čistoća" since the beginning of the year.

In his statement to Vukadinović, which "Vijesti" had access to, the executive director of "Čistoća", among other things, affirmatively answered that there was employment in that company from the beginning of the year until May 18.

"Also, five employees with VII 1 level of education, all in accordance with the needs of the work process and the needs of work organization, were hired," he said.

Of these, there are two persons with a technical college degree, for the positions of "independent officer for the development of new technologies" and "independent officer for development and investments". For the latter, the candidate could have completed a technical or social sciences degree, according to Čađenović's statement.

Two more persons from social sciences were employed, in the positions of "independent officer for collection of claims for legal entities" and "independent officer for control and records of claims for legal entities". According to Čađenović's statement, since the beginning of the year, "Čistoći" needed a person with a law degree for the position of "independent officer for normative activity and legal affairs".

Although Vukadinović did not mention it in the request, Čađenović referred in part of the answer to former employee Denis Hota, who was fired from that Podgorica utility company in 2019, when he initiated and later won a dispute against his previous employer.

In the meantime, "Cistoći" received fines for non-compliance with three executive rulings, so the company is obliged to pay 2.500 euros, and the responsible person - the executive director, 800 euros.

Čađenović's mandate expires tomorrow.

In the statement, he states that the verdict regarding Denis Hot's return to work was rendered by the Basic Court in Podgorica on May 16, 2022, and that Hot, from the moment of its adoption, had the right to request reinstatement within 60 days. He also said that Hot, through a lawyer, exercised his right on February 3, but that the jobs to which he could be assigned according to the court verdict were already filled at that time.

As he stated in his statement, the positions for which a technical faculty is necessary or desirable, which is the case with Hota, are employed by persons who have been working for a fixed period of time in "Čistoća" for a long period of time.

"And who, with their work, effort, commitment and professionalism, more than justified the appointment to the above-mentioned positions", stated Čađenović in his statement. He added that Hot, after requesting through a lawyer to be reinstated, was informed that at that moment there were no vacant positions to which he could be assigned in accordance with his level of education, and that the employer, in order to act according to the verdict, take steps to return the employee to work, "for which it is necessary to comply with the administrative procedure, because 'Cistoća' does not have the right to independently change the Act on systematization and open a new workplace".

He also noted that Hot was employed at the "Ivan Uskoković" Secondary Vocational School in Podgorica at that moment. "Čistoća" used that argument in the appeal before the court, but in early April, the court, rejecting the objection, appreciated that the fact that he is employed in another workplace does not exclude the right of the former employee to return to work at the Podgorica utility company.

Andrija Čađenović has been in "Čistoća" since February 2019, first as an acting director, and then as an executive director since June of the same year. Previously, since May 2015, he was the commander of the Capital City Protection Service.
