Notary activity is an area in which advertising is prohibited, said the Chamber of Notaries of Montenegro.
They reacted to the announcement of the Municipality of Zeta, which states, among other things, that a notary has started working in Zeta.
The Chamber of Notaries stated that they feel obliged to provide certain clarifications in relation to the allegations made in the aforementioned announcement.
"First of all, the Chamber of Notaries congratulates the newly appointed notary on the start of her work, and also congratulates the newly formed municipality of Zeta on obtaining another important characteristic of the municipality as a local self-government (and the beginning of the work of a notary as a person of public trust is certainly that). But, the Chamber of Notaries must point out that it is stated in the announcement that "All the tasks that our citizens had to perform at the notary in Podgorica, can now be performed in our Municipality" there are many elements that could confuse and mislead the citizens of Zeta and lead to the mistaken belief that the tasks under the jurisdiction they can perform notary services only at notaries in Zeta. Therefore, the Chamber of Notaries informs the public that notaries appointed for the official area of the Basic Court in Podgorica have the territorial authority to perform notarial work for all municipalities that fall within that area. This practically means that notaries based in Podgorica can continue to perform tasks for the area of the municipalities of Zeta and Tuzi, and notaries based in Tuzi and Zeta can perform tasks for the area of Podgorica as well," the announcement states.
They said that it should also be known that notary activity is an area where advertising is prohibited.
"The Chamber of Notaries reluctantly notices that in the published announcement of the local self-government there are elements of indirect advertising and promotion of a notary (listing contact details, address, etc.), which is contrary to the Code of Notarial Ethics. What's more, if an announcement of this content and character were to be published for some notary, this would be the basis for initiating disciplinary proceedings for a serious violation of notarial duty from Article 112 paragraph 2 point 3 of the Law on Notaries. That is why we believe that the authors of such announcements should be careful what information and in what way they publish in order not to get into a situation that they break the law or present half-information that could mislead citizens," concluded the Chamber of Notaries of Montenegro.
