Podgorica Dzeko Muratovic he fails to collect the damage of at least 20.000 euros caused by his neighbor Vlatko Vukanović, despite the fact that the verdict of the Nikšić Basic Court has been legally binding and enforceable for two years.
Muratović's proxy, lawyer Dalibor Kavarić he told "Vijesta" that Vukanović borrowed money from his client back in 2012 and in exchange promised to give him a plot - 10.000 square meters in the Kuće Rakića settlement.
"What Vlatko's father agreed with Petar, given that the property that Muratović bought was registered to the elder Vukanović," said Kavarić.
However, Vukanović was sold the plot to a third person in the meantime.
The fact that the verdict is final and enforceable, explains Kavarić, means nothing for Muratović, because he cannot return the money.
"During the proceedings, the court refused to oblige Vlatko's father, Petar Vukanović, to pay Džeko Muratović the amount of 20.000 euros," emphasized Kavarić.
Vlatko Vukanović told "Vijesta" that he was on his way, that he would later comment on "what the gentleman is making up".
Kavarić points out that "the whole story got an additional twist when the Vukanovićs (Petar and Vlatko) sold the land intended for Muratović to a third party - a certain Z... ”.
"... Koji registered that plot in his name, refusing to hand over the land to Muratović, even though he knows that the real estate was originally sold. The essence of the problem is that Vlatko Vukanović was selling the property that belonged to his father Petar, and with his consent, in what way did the property they sold to Muratović be resold to Z... and in this way they all together defrauded Muratović who left without the land he honestly paid for," says Kavarić.
The Basic Court of Nikšić obliged Vlatko Vukanović to pay the amount of 20.000 euros on behalf of the debt, as well as the statutory default interest from the date of filing the lawsuit until the final payment.
"...And within 15 days of the finality of the verdict, under the threat of forced execution," reads the verdict, which "Vijesti" had access to.
In the explanation of the verdict, it is stated that Muratović, before the dispute arose, bought land from Vukanović, which is why he trusted them.
"At their request, in March 2012, based on a verbal agreement, he handed them 30.000 euros, and the defendants undertook to return the money by March 2013, or they would hand over the land to the plaintiff in an adequate counter value. The defendants have repeatedly returned the amount of 10.000 euros from the total debt, but not the remaining part of the money, despite the fact that he repeatedly warned them to return the money or hand over the land. "Because of this situation, the prosecutor filed a criminal complaint with the Police Directorate, which was rejected because it was a civil-legal relationship," the verdict reads.
According to court documents, Vukanović played Muratović several times over the years, otherwise working temporarily in Luxembourg.
According to the explanation of the verdict, in November 2016, Muratović submitted a report to the police against the younger Vukanović, claiming that he had deliberately and fraudulently embezzled 20.000 euros from him. He supplemented the statement during the following months.
"...From the record of the notification collected from the citizen from December 2016, it follows that Petar Vukanović stated that he did not sell the land to Muratović, that he is the owner, and that his son was not authorized to do so, and that he was aware of the fact that his son borrowed money from Muratović, claiming that they wanted to start a business together...", the verdict states. At the end of 2016, the elder Vukanović told the police that Muratović was "blackmailing him because Vlatko owed him, so he wanted to buy the land for five euros per square meter."
"...As it was established in the proceedings that the debt of the defendant, in the name of the loan given to him by the prosecutor, is 20.000, and the legal provisions that the parties in an obligation relationship are extended to fulfill the obligation...Muratović Džeko rightly demands that Vukanović Vlatko be obliged by the court's decision to payment of the debt in question", the judgment states.
Muratović, as explained by his attorney, lawyer Kavarić, has not yet been compensated in the manner stipulated by the final and enforceable court decision.
