The media center submitted a request to the members and president of the Prosecutor's Council, Tatjana Begović, to warn the competent prosecutor's offices to promptly conduct proceedings due to non-compliance with court rulings, said the director of the media center, Goran Đurović.
"The media center reminded the Prosecutor's Council that on June 8 this year it filed criminal charges against the president and members of the RTCG Council: Veselin Drljević (president), Filip Lazović, Naod Zorić, Predrag Miranović, Amina Murić, because as public officials they refused to execute final and enforceable court verdicts and enabled the acquisition of illegal benefits to the illegally elected general director of RTCG Boris Raonić, thereby committing the criminal offense of non-execution of a court verdict from Article 395 and the criminal offense of abuse of official position from Article 416 of the Criminal Code of Montenegro," said Đurović, it is stated in the press release of the Media Center.
On the same day, as he said, criminal charges were filed against RTCG General Director Boris Raonić, head of the RTCG legal department Želimir Mićović and RTCG lawyer Zorica Đukanović, because, he added, they encouraged the president and members of the RTCG Council to commit a criminal offense non-execution of a final and enforceable court verdict and enabled the acquisition of illegal benefits to the illegally elected general director of RTCG Boris Raonić, thereby committing the criminal offense of inciting the commission of a criminal offense under Article 24 of the Criminal Code of Montenegro.
"We have been informed by the media that the Special State Prosecutor's Office (SDT) formed a case regarding the criminal complaint against members of the RTCG Council, while the Basic State Prosecutor's Office formed a case regarding the criminal complaint for incitement to commit a criminal offense against Boris Raonić, Želimir Mićović and RTCG lawyer Zorica Đukanović ", the statement added.
Media cenar, as they said, reminds the Prosecutor's Council that the Basic State Prosecutor's Office (ODT) heard RTCG General Director Boris Raonic, Head of RTCG Legal Service Želimir Mićović and RTCG lawyer Zorica Đukanović on June 22, and since then there has been no new information regarding this case .
"We believe that on the basis of the criminal complaint it was easy to determine who, in the capacity of a citizen, can be called by the ODT to clarify the essential circumstances of this case. We believe that statements can be taken from the members of the RTCG Council who participated in the Council session held on June 1 as well as in preparatory meeting held on May 31 (Veselin Drljević, Filip Lazović, Naod Zorić, Predrag Miranović, Amina Murić, Milica Špajak, Marijana Camović Veličković, former Council member Bojan Baća) as well as from the person from the legal affairs department - Želimira Mićović (manager). and Irene Vešovć, RTCG lawyer Zorica Đukanović, RTCG officials Mitra Rakčević and Ivan Leković. According to our information, invitations to give statements were not sent to members of the RTCG Council, nor to other officials," the Media Center announced.
In the case before the Special State Prosecutor's Office, Đurović added, according to the Media Center's knowledge, the members of the RTCG Council were not heard in order to determine whether there is a well-founded suspicion that they committed the criminal offense of non-execution of a court verdict from Article 395 and the criminal offense of abuse of official position from Article 416 of the Criminal Code of Montenegro.
"We remind you that on May 10, 2023, the High Court in Podgorica issued a verdict confirming the decision of the Basic Court in Podgorica that Boris Raonic was illegally elected to the position of General Director of RTCG in August 2021 due to the existence of a conflict of interest. the possibility for the defendant (RTCG) to choose a new general director from the remaining candidates in the 2021 competition or to re-announce the competition," Đurović added.
The media center draws the attention of the Prosecutor's Council, as announced, to the harmfulness of non-compliance with final court judgments and the very important role of the state prosecution in preventing anarchy, which is encouraged if the prosecution does not treat cases of non-compliance with final court judgments as a priority.
"By delaying the decision-making of the prosecution in these cases, a clear message is sent to citizens that they or any long legal entities should not respect the final decisions of the courts because there will be no sanctions. By remaining silent and slow to react in connection with ignoring final judgments, the state prosecution becomes an accomplice in the collapse of the rule of law. If the leaders of political parties, the Prime Minister, the President of the Assembly and the President of the State are silent because of their personal interests about disobeying final court rulings, the State Prosecutor's Office must not be silent," the statement said.
We call on the Prosecutorial Council, as stated, to act proactively and to warn the competent prosecutor's offices to promptly lead proceedings for non-compliance with court rulings in order to avoid possible complaints about the work of state prosecutors and heads of state prosecutor's offices regarding the legality of their work.
