The Trade Union of Administration and Justice of Montenegro announced that it has submitted a criminal complaint to the Special State Prosecutor's Office (SDT) against the Director of the Agency for the Prevention of Corruption (ASK), Jelena Perović.
"Representatives of the Administration and Judiciary Trade Union and the Trade Union Organization of the Agency for the Prevention of Corruption, Nenad Rakočević and Bulat Bulatović, as employees of the ASK and members of the Trade Union, filed a criminal complaint with the Special State Prosecutor's Office for abuse of official position, i.e. falsification of documents or records," the announcement states. They pointed out that the representatives of the trade union also submitted to the Initiative for constitutionality evaluation the Rulebook on the systematization of workplaces, which was adopted by the Council of the Agency on the proposal of Director Jelena Perović, whose mandate expires in a few days.
"All these actions are taking place in this important state body, whose purpose is prevention and removal in terms of irregularities and illegality," it added.
"For some time now, the Montenegrin public has been very interested in certain events in the Agency for the Prevention of Corruption. That the situation within this important state control institution is not flawless can be seen from the publicly known events or affairs such as the use of the famous extra luxury official car, and the intention is suspected for the purchase of another such, as well as the public tender announced for the procurement of extra luxurious, expensive mobile phones intended for the members of the management and the composition of the outgoing Council of ASK. However, it can be said that these affairs will obviously not be alone," the statement reads.

The union emphasized that the director of ASK, in "a personal war of her own", made the decision to initiate disciplinary proceedings against the employee and union member Bulat Bulatović, that is, against the president of the union of this body, Dušan Drakić.
They said that they suspect that the intention is to permanently eliminate the mentioned persons from KAS, and that the ways in which the director carries out these activities, together with related persons, are illegal and "incorrect, to say the least."
"For this reason, a criminal complaint was submitted, because we suspect that illegal means were used in the implementation of their intentions, and this will ultimately be confirmed by the letter of the law. Among other things, this is only the beginning of various processes that the union will initiate against the director and several responsible related persons ", it is stated in the announcement of ASK.
The union pointed out that on May 29 this year, the KAS Council adopted the Rulebook on the internal organization and systematization of workplaces, according to which, according to them, significant transfers and degradation of a large part of the official staff of this institution were planned, with an emphasis on expert staff.
"What were the motives and reasons that forced the director and the majority of the Council to collapse the profession in this institution, the employees and the public will know precisely in the future, and until then the Trade Union Organization of the ASK and the Trade Union of Administration and Justice of Montenegro, to which this trade union organization structurally belongs have already taken the appropriate legal steps in the form of the submitted Initiative for the evaluation of the constitutionality of the legality of the systematization," the statement added.
They explained that the narrowly professional composition of the KAS expert staff from the position of independent advisor I, with the new systematization, is planned to be demoted up to five positions back (senior advisor III).
"According to the Minutes from the session of the ASK Council, the reasons for the demotion of the title are comical and illogical, they only serve to mask the eyes of the readers and possibly those who would monitor and evaluate the legality of this act. According to the suspicions of us union representatives, we are working here to eliminate narrowly specialized officials who worked on very important and responsible reports, in the future they should also work on very important cases that one suspects do not want to see the light of day," the Union's announcement reads.
They said that "the behind-the-scenes planned game of the management of ASK ultimately leads to the well-founded suspicion that the elimination of a good part of the employees is planned in the end, or simply that the ultimate goal is their dismissals, in a way that the degradation of their titles would point to their incompetence and unnecessaryness", while are, as stated in the announcement, favored in various ways by employees under various types of illegal contracts that the director has been employing since the beginning of her mandate.
They emphasized that the union representatives have taken the first steps in the legal protection of the employees of this institution, and that all those who have violated the laws of Montenegro in any way will be prosecuted.
"It is symptomatic that this institution should work on sanctions and prevention in accordance with the laws and interests of Montenegro, and not be a source of affairs and illegal actions with its actions," it added.
"For this and those reasons, disciplinary proceedings were initiated against the President of the union for bizarre reasons, and the process of making a decision on suspension from work is underway in order to prevent his union activities and to continue pointing out irregularities within the ASK, which has been happening for a long time period", concludes the statement of the Trade Union of Administration and Justice.
