Staircase privatized, tenants in fear

The question of the ownership of the staircase in Kolašin, which has long been no longer municipal, but private property, has recently been intensified by the tenants of nearby buildings, fearing that any construction in that place would cause them immeasurable damage.

The staircase in the narrowest center of Kolašin, i.e. the only passage from IV Proleterske (Sibirska) Street to Fallen Partizanka Street, has not been owned by the Municipality for 16 years. Plot 434/5, which includes that part of the pedestrian infrastructure, moreover, in the records of the Administration for Cadastre and State Property, it is kept as barren land.

According to the Administration, the current owners are Miroslav Rakočević i Dejan Kascelan, but in 2007 they bought a plot of land from a now deceased man from Kolašinac who bought a valuable plot in the center of Kolašin that same year from the Municipality.

The area of ​​247 square meters (staircase) was sold by the Municipality at a price of 24.700 euros in June 2007. Two months later, the neighboring lot 10.000/434, whose area is 3 square meters, was sold to the same man for 107 euros. Already in September, a valuable public space in the core of Kolašina became the property of Rakočević and Kašćelan, and it remains so to this day.

"On the cadastral plot 434/5, a record of the dispute was entered according to the lawsuit P. no. 48/12, which was filed with the Basic Court in Kolašin. Also, a lien-mortgage in favor of the Municipality of Kolašin, in order to secure a tax claim, in the amount of 413 forced collection of euros is the use of Dejan Kašćelan", they told "Vijesta" from the Administration.

According to their data, among the "encumbrances" on that plot is a mortgage in favor of the Municipality based on taxes in the amount of 2.537 euros. Kašćelan's half of the immovable property is also referred to by the decision on execution Iv. no. 345/2017 dated October 26.10.2018, XNUMX of the public executor. Darko Rajković. As they claim in the cadastre, from 2007 until now there have been no changes to plot 434/5.

Tenants of nearby buildings claim that the eventual intention of the current owners to build on that lot would cause multiple damage to the owners of the apartments, especially one of the buildings in IV Proleterske Street. The new construction, they explain, would close all the windows on the side of the building. In addition, given that the property of Rakočević and Kašćelan is also the part where there are now three parking spaces and the access to the building's boiler room, the apartment owners explain that they would be "closed" from that side as well.

"Construction on this plot must not be allowed, before we are provided with normal functioning. If a building were to be built on that plot, the windows of some apartments would be closed on two sides. The approach for bringing in wood would also be impossible, because it is only possible from the Street of fallen partisans", one of the apartment owners told "Vijesta".

Rakočević told "Vijesta" that three parking spaces were built on the plot, which he co-owns, in previous years. Also, he claims that the staircase and other parts of the plot have been used as public space for all 16 years and that the co-owners have never caused a problem. He offered the public all the documentation, from which, as he says, it can be seen "that the plot was purchased in accordance with the law from a private person", and that Kašćelan and he did not trade with the Municipality. According to him, in the case of construction of buildings, a passageway would also be built, which would enable a connection between IV Proleterska and Palih partizanki streets.

According to the Administration, another plot, on the right, at the beginning of the stairs in IV Proleterske Street, is private property. The area of ​​that plot is 177 square meters.

At the time when the Citizens' Group was in power in Kolašin, in coalition with the Democratic Party of Socialists, a lot of municipal land was sold. In addition to the large plots of land in the sports zone, which were sold or bartered and ended up as the property of private individuals, the Municipality also sold one of the streets next to the current "Sheraton" hotel to the PIO Fund.
