Citizen initiative Zdravi Mojkovac filed a criminal complaint against Minister of Capital Investments Ervin Ibrahimović and State Secretary Admir Šahmanović for abuse of official position in the case of the Brskovo mine, the organization announced.

"In the criminal report, we stated that Ervin Ibrahimović and Admir Šahmanović, in their capacity as Minister of the Ministry of Capital Investments and State Secretary in the same ministry, were aware of their act, the execution of which they wanted to illegally exploit their official position and their powers and by exceeding them, obtain benefits for others, cause harm another and more likely to violate the rights of others in a way that is contrary to the imperative regulations of the Concession Agreement for detailed geological research and exploitation of sulphide polymetallic ore (Pb, Zn, Cu, FeS2 and other accompanying metal sulphides) in the exploration and exploitation area of the former mine "Brskovo" near Mojkovac, number 01-3660/1 dated 10.12.2010, Annex 1, Annex 2, Annex 3, Annex 4, Annex 5 and Annex 6, as well as by unlawfully using their official position and their powers prevented the termination of the contract despite obtaining the conditions for the termination of the Agreement, and the Ministry of Capital Investments did not send a Notice to the Concessionaire about it, thereby committing the criminal offense of abuse of official position from Article 416 paragraph 2 in relation to paragraph 1 of the CC of Montenegro and on the basis of Articles 255 and 256 of the CC," it is stated in the announcement of GI Zdravi Mojkovac.

The contract, as they say, expired on July 25 of the current year, and from that organization they claim that they have informed and warned the Government of Montenegro and the Ministry of Capital Investments, which, according to them, is responsible for terminating the Contract, and the Ministry of Ecology and Spatial Planning countless times and urbanism.

"The contract stipulates that the Concessionaire was obliged to fulfill all legal obligations by July 25, 2023, which he did not do. This created the conditions for the Ministry of Capital Investments to send a notification to the Concessionaire that all the legal conditions for terminating the Contract have been met and without no consequences for the state of Montenegro," they added.

They said that although they wrote to Minister Ibrahimović, Secretary Šahmanović, Minister Novaković Đurović and Prime Minister Abazović, they did not take any action to protect the state of Montenegro, the property of the state of Montenegro and the citizens of Montenegro, primarily Mojkovac.

"Failure to act in accordance with legal norms and the official duty of all the aforementioned decision-makers puts before us the answer: abuse of official position for the sake of obtaining benefits for the Concessionaire and the creation of an organized criminal group that threatens the constitutional right to life, safety and health of the citizens of Montenegro, and primarily of Mojkovac", it is stated in announcement of GI Zdravi Mojkovac.

They stated that they hope that the Special State Prosecutor's Office (SST) will act according to the laws of Montenegro, form a case and carry out justice in the interest of constitutionally guaranteed rights to life, safety, health and a healthy environment.

"And in the end, with their latest media appearances that are on the edge of the Concessionaire's PR service and contrary to the interests of the state and citizens, we recommend the tandem Abazović and Novaković Đurović to ask themselves whether they are "on the right track", they concluded.
