For the Ministry of Education Zoran Djukic he is not the director or acting director of the elementary school "Savo Pejanović" in Podgorica, and they do not know who performs that function.
On the other hand, according to unofficial information, Đukić never received a decision about his dismissal and even these days, when he gives statements to the media, he presents himself as the school's director.
The school board, also according to unofficial information, did not schedule a meeting, nor, according to "Vijesti" interlocutors, did they receive any information from the Department of Education regarding the election of the director of one of the oldest schools in Podgorica.
The management of the "Savo Pejanović" primary school did not respond to the questions of "Vijesti" about the status of Đukić.
In April, the Higher Court in Podgorica issued a verdict that overturned the earlier verdict of the Basic Court and annulled the decision of the then Ministry of Education, Science, Culture and Sports on the selection of candidates from March 25, 2022, and at the same time, that department obligates that within 15 days from the date of entry into force , carry out a re-selection among the candidates who applied for the position of principal of Elementary School "Savo Pejanović" on November 15, 11.
In the judgment of the High Court, which "Vijesti" had access to, it was stated that the School Board then announced a competition, that Zoran Đukić and the previous director applied for the competition. Biljana Krivokapic, that the Ministry, deciding on that competition, on March 25, 2022, made a decision that Đukić will be the director of the elementary school in Podgorica for the next four years.
The verdict also stated that previously, while Đukić was in the position of acting administrator, the educational inspection determined that he did not meet the requirements of the competition, because the type of education he has - B.Sc. mechanical engineer, is not provided as a condition - the possibility of teaching for any of the planned regular or optional subjects.
As stated in the judgment, the Ministry of Education in the act dated 5/12/2022 also gave the opinion that "a person who has obtained the professional title of B.Sc. mechanical engineer and master of technical sciences does not meet the requirements for a classroom teacher, as well as for a subject teacher in elementary school in terms of the field (profile) of education, since the profile mentioned is not intended for any subject in elementary school".
"Vijesti" announced that Đukić does not meet the requirements for the directorship in July 2021, when, among other things, it was announced that, before being appointed to replace the previous director Biljana Krivokapić, as a teacher of the mechanical subject group, he taught at the Podgorica Secondary Vocational School "Ivan Uskoković".
From the Ministry of Education, Science, Culture and Sports, which she led Vesna Bratic, then they did not answer the question of "Vijesti" whether the appointment of Đukić was in accordance with the law.
From the Department of Education, which he heads in a technical mandate Miomir Vojinović, told "Vijesta" that based on the verdict of the Podgorica High Court, on July 12, they made a decision that the competition for the election of the director of the primary school "Savo Pejanović" on November 15, 2021, will not be held.
They reminded that Zoran Đukić and Biljana Krivokapić had applied for that competition, and that then the minister found that Đukić, with a degree in mechanical engineering, did not meet the requirements for the principal of an elementary school, and that in the case of Krivokapić, he determined that the development program of the institution that she offered "it was not done in a systematic way, it does not provide a comprehensive analysis of the state of the institution and it does not contain detailed activities relevant to achieving the goals...".
"Keeping in mind that the provisions of Article 80 paragraph 1 of the General Law on Education stipulate that the director is selected on the basis of a public competition and the submitted program of development of the institution, I decided not to make the selection according to the Competition for the selection of the director of the Junior High School 'Savo Pejanović' Podgorica Vojinović stated in the decision.
From that department, they told "Vijesta" that they submitted that Decision to the school for further processing.
"Bearing in mind that according to the provisions of Article 80 paragraph 6 of the General Law on Education and Training, the director of a public institution is elected and dismissed by the school, i.e. the board of directors by majority vote, from May 1, 2023, the Ministry submitted its decision after the execution of the court verdict JU Elementary School 'Savo Pejanović', Podgorica, for further action. "The school was obliged to schedule the School Board and appoint an acting director of the school after receiving the decision, in order to ensure the continuity of the school's work," they told the newsroom.
After that, as they added, the School Board is obliged to announce a competition in accordance with the Law and select a director.
"The Ministry of Education did not receive a notification from the school that an acting director of the school was appointed, nor whether a competition was announced," they told "Vijesta".
For further information about the election of the principal and acting principal and their responsibilities, the editorial office was directed to the School Board of the Podgorica Elementary School.
According to unofficial information from "Vijesti", the School Board did not receive a decision from the Department of Education.
The former director is suing them, everything is over for the Ministry
On August 8, the former principal of the "Savo Pejanović" Primary School, Biljana Krivokapić, filed a lawsuit against the Ministry of Education for the decision not to hold a re-election for the November 2021 competition.
As stated in the lawsuit, which "Vijesti" had access to, she received the decision four days earlier and considers it to be completely illegal.
Commenting on the explanation that she does not meet the requirements for the selection of the school director because she did not offer a valid development program, the lawsuit states that the minister did not state in a single sentence what the deficiencies in the completed program and other documentation submitted by the plaintiff are...
"And which contains a detailed plan for the development of an educational institution. From the above, it follows that the defendant acted completely contrary to the final judgment of the court...", the lawsuit says.
On July 3, the Basic Court in Podgorica passed a decision ordering the Ministry of Education, if it does not comply with the High Court's ruling within the prescribed period, to impose a fine of 2.000 euros, and the responsible person 500 euros.
On August 8, Biljana Krivokapić's attorney submitted to the Basic Court a request for enforcement of the imposed sentence, in which he states that the Ministry of Education has not fulfilled its obligation, and at the same time proposes a new deadline and the imposition of a larger fine, if they do not do so even within the new deadline.
The Department of Education told "Vijesta" that the Ministry, in relation to Krivokapić, "completely carried out the verdict".
"We have already explained that according to the verdict none of the candidates from 2021 were elected. Before making the decision on the election of the director after the execution of the verdict, the Ministry carried out interdepartmental consultations on the authority of the authority for deciding on this verdict, bearing in mind that from the date of filing the lawsuit until the execution, the law was changed in such a way that the Ministry no longer selects the director", it is written in the reply submitted to "Vijesta".
