The municipality of Bijelo Polje (ni) donated the land to the Dulović family

Bjelopoljac Hajrudin Hadžibegović, who lives in Germany, claims that the Municipality of Bijelo Polje illegally gave his land to his family through the Sports Fishing Club (SRK) "Sinjavac" Ranko Dulović, to the owners of the restaurant "Ušće".

At the last session of the local parliament, a decision was adopted on the transfer of the right of disposal on construction land, by which the Municipality of SRK transfers the right of disposal on immovable property on cadastral plots, namely a bank with an area of ​​61 square meters, a forest of the fifth class with an area of ​​466 square meters and pasture VI class size 24 square meters, registered in the list of immovable property of KO Voljavac in the name of the Municipality.

The transfer, as stated in the decision, is carried out for the purposes of the local study of the location "Ušće", the completion of the urban plot, with a fee, according to the assessment of the competent commission.

That decision was criticized by the Movement Europe now, stating that the fishing company is used to make concessions to the Dulović family, and that SRK is just a flow boiler of that family, which needs to be investigated. And the municipal committee of the Party of Justice and Reconciliation submitted a criminal complaint to the Special State Prosecutor's Office (SDT) against the president of the Municipality of Bijelo Polje. Petar Smolović, director of the Directorate for Property and Rights Protection Ljubomir Sošić, the owner of the company "Bus" Ranko Dulović and the president of SRK "Sinjavac" Ismet Softić, due to illegal alienation of municipal property. In the criminal complaint, it was stated that Smolović organized a meeting with them in his office, at which they agreed that the municipal property located at the confluence of the rivers Lim and Bistrica should be illegally transferred to Dulović, who opened a restaurant at that location, at the place on to which there was a Fisherman's House, and which he ceded to himself in agreement with the president of SRK "Sinjavac" through a lease agreement.

Hadžibegović told "Vijesta" that he has a title deed from 1973, as well as from 2005, according to which the land belongs to Hadžibegović (Hajrudin's mother). The land was registered in 1934, 30.038 square meters, in the name of Džemila Hadžibegović.

"I call on the local parliament to cancel this illegal decision, and state institutions to investigate how the Bjelopolje Real Estate Administration transferred my property to the Municipality, to investigate all persons who committed criminal acts in that dirty business. Although he is the president of the municipality Petar Smolović was well aware that the property belongs to my family and that there are court cases, he submitted a proposal to gift it to the Dulović family", said Hadžibegović.

He pointed out that the Hadžibegović family will continue to fight for their property, if necessary, even as far as Strasbourg, but that they will not give up their father's property.

Admir Camic from the Justice and Reconciliation Party announced that because of this case, the citizens of Voljavac and Gubavč will protest in front of the Municipality building, where they will call each councilor by name, 18 of them who donated to the Dulović family, which is located in Ušće, and demand that they testify at the prosecutor's office. He stated that in order to approach the beach at Ušće, the locals now need to ask for permission from the Dulović family.

President of the Ministry of Health Gubavac Ermin Kovačević stated in the statement submitted to "Vijesti" that the council and the Ministry of Health disclaim any responsibility related to the mentioned procedure and that land.

"We also note that neither the municipality of Bijelo Polje nor the fishing company "Sinjavac" have met or asked for any opinion or consent from the Gubavac Municipality. We leave the correctness of this procedure to the judgment of the state authorities and the general public", said Kovačević.

Director of the Directorate Ljubomir Sošić reminded that in 2014 the Municipal Assembly adopted the Local Study of the "Ušće" location.

"And in accordance with that location study, i.e. a small DUP, the urban plot that is the subject of this notice is also planned, that is, the completion of the urban plot at the request of the owner of the building and the cadastral plot, all taking into account the legal norm" the owner of the cadastral plot is obliged to suffer changes in the boundaries of the urban plot,'' said Sošić in his reply to "Vijesta".

He explained that the decision "has as its object the bringing of the DUP to the purpose, i.e. the completion of the urban plot, which in relation to the acquisition of urban plots was defined back in 2014 with the adoption of the "Ušće" location study.

Also, he emphasized, the issue of restitution was under the jurisdiction of state authorities, primarily the Commission for Restitution and Compensation, which resolved the procedure with finality, and according to that final decision, the Real Estate Administration deleted the burden of restitution.

"Accordingly, the immovable property in question is clean from the aspect of all burdens. We especially point out that the locality in question will be the focus of attention and checks, whether there are any usurpations of municipal property by physical or legal persons, and bearing in mind the initiatives, these days, by certain political entities, as well as non-governmental organizations, already these days competent services will scan everything in that area and accordingly undertake appropriate activities in terms of protecting state property, without exception", concluded Sošić.

For years, the Municipality of Bijelopolska had a dispute with SRK "Sinjavac" regarding the ownership of the fisherman's house, because that object was originally registered with the Municipality, i.e. it was owned by the Municipality, however, "SInjavac" got the right of ownership over that object.

"The court has legally decided that they are the owners of that immovable property, and the dispute went through different stages in the domestic judiciary, from the Basic Court, the High Court, the Supreme Court and the Constitutional Court," said Sošić.

In the decision of the Cadastre Administration from May of this year, which "Vijesti" had access to, the state Cadastre Administration deleted Hadžibegović's request for restitution, because the restitution commission rejected his request and requested the deletion of the note.

"The defendant is obliged to recognize and enable the plaintiffs to register with the Real Estate Administration as co-owners with the associated rights, as well as the plaintiffs' proposal for determining a temporary measure to prohibit the defendant and third parties from carrying out any construction and other works on the mentioned plot, until the end of the litigation of the procedure", it is stated in the judgment of the Basic Court.

Dulović: The courts have had their say, it's about another plot

Member of the Board of Directors of SRK "Sinjavac" Ranko Dulović said that the case went through seven court instances and that the verdict was in favor of SRK "Sinjavac".

As for the Hadžibegović family, he said they lost the case before the state authorities and that the plot is not even located on the plot where SRK "Sinjavac" is located.

"Nevertheless, we leave it to the judicial authorities to examine all the circumstances of the case, after which I will make a more detailed statement", said Dulović, noting that even the plot that was related to sub-parcelization does not in any way affect the plot of Hadžibegović.
