The company "Cijevna komerc" falsely presented itself as a concessionaire and extracted stone from the location "Lopata" in the territory of Podgorica. Those activities, as it is assumed, caused damage of tens of millions of euros.
This, among other things, was told to "Vijesta" by the Directorate for Inspection Affairs (UIP), whose Mining Inspection had previously obtained information and evidence about the behavior of that company at the "Lopate" location, where they allegedly opened a "mine" of technical and construction stone.
The company "Cijevna Komerc" did not respond to the editorial questions.
"The economic company 'Cijevna komerc' doo Podgorica was not registered in the register of concessionaires who signed a concession agreement with the Government of Montenegro for detailed geological research and exploitation of technical-building stone from the location 'Lopate' in the municipality of Podgorica", they told "Vijesta" from of the UIP.
As they added, the Mining Inspection exclusively carries out supervision based on Article 114, paragraph 1, point 1 of the Law on Mining, controls concessionaires - not any other legal or physical persons or entrepreneurs, whether they have permission to perform works.
Until now, as the UIP said, several state bodies and natural persons, through submitted initiatives, were interested in the alleged control of stone exploitation from the "Lopate" location, and they were rejected with decisions to carry out inspections, due to the lack of jurisdiction of the mining inspection, and the solutions are became legally binding.

However, they add, "how the Mining Inspection came to know and evidence that the above-mentioned company acted as a 'concessionaire', and that it allegedly opened a 'mine' of technical-building stone, without a concession contract", against the company "Cijevna komerc" ” Last year, a criminal complaint was submitted to the Special State Prosecutor's Office (SDT) in Podgorica.
"As well as against several legal and natural persons who participated in helping the above-mentioned company, because the presumed damage caused amounts to several tens of millions of euros. Currently, the case is with the special prosecutor, Mrs. Milanović, in the SDT Podgorica", told "Vijesta" from the Directorate for Inspection Affairs.
Information about the fact that "Cijevna komerc" exploits stone at the "Lopate" location is stated in the documentation that was submitted to the Prosecutor's Council (TS) through a statement.
At the session held on October 16, the Supreme Court considered the reports submitted by the SDT and the Basic State Prosecutor's Office (ODT) in Podgorica and the ODT in Kolašin regarding the cases formed on the occasion of criminal reports on the illegal exploitation of gravel in the period from 2018 to 2023.
In one of the documents, which "Vijesti" had access to, the special prosecutor Zorica Milanović, in a statement to the chief special prosecutor Vladimir Novović, she stated that she was not provided with cases on the illegal exploitation of gravel, but that in October 2022 she was assigned a case formed on the occasion of the submission of a criminal report by the UIP Mining Inspection against the company "Cijevna komerc" and several other persons in the case of illegal production and processing of stone aggregate from the location "Lopate" in Podgorica, specifically the exploitation of non-metallic mineral raw materials, technical-building stone.
Among other things, Milanović also stated that the Ministry of Capital Investments (MKI) also submitted a statement about this in mid-April and that in the statement they stated that "Cijevna Komerc" did not apply to that department with a request for exploitation, that the Ministry of Economy and the Ministry of Economy ( which included the Directorate for Mining, Geology and Hydrocarbons) stated that the location of "Shovel" was not proposed either in the annual plans, or in additions to those plans, for granting concessions for detailed geological research and exploitation of mineral raw materials. They also stated that the Government of Montenegro, that is, the Ministry of Interior, has not concluded a contract for such research at the location "Lopate" with the company "Cijevna komerc", nor with any other company.

It is also stated that the MKI, after concluding the concession contract for detailed geological research and exploitation of mineral resources, submitted a copy of the contract to the Supreme State Prosecutor's Office, and that after receiving information from the Anti-Corruption Department of the MKI, the factual situation at the location should be determined. Lopate", the Directorate for Mining on October 15, 2021, in accordance with the Decree on entrusting part of the tasks under the competence of the Ministry of Economy, sent a request to the Institute for Geological Surveys, requesting to survey the terrain and inspect the existing documentation.

At its session on October 16, the TS was informed about the actions taken by the competent state prosecutor's offices (SDT, ODT Podgorica, ODT Kolašin) in connection with the illegal exploitation of gravel from riverbeds in the territory of the Capital City of Podgorica, the Municipality of Zeta and the Municipality of Kolašin.
After that session, they called on the State Prosecutor's Office to intensify proceedings in cases in which the State Prosecutor did not make an appropriate decision, for the State Prosecutor's Office to inform the Prosecutorial Council in a timely manner about the verdicts passed by the competent courts in cases in which court proceedings are ongoing.
TS called on the competent prosecutions to consider and notify v. d of the Supreme State Prosecutor, whether the application of the regulations in practice shows that it is necessary to propose certain amendments to the regulations governing misdemeanor liability and criminal liability. They called on the State Prosecutor's Office to point out the possibilities to improve the appropriate regulations and practice of the competent inspections, police officers and prosecutors, to carry out a complete analysis of the capacities and the need for further specialization of the State Prosecutor's Office for dealing with cases of criminal offenses against the environment, especially when of such acts creates significant illegal property benefit, to the detriment of state property, and to integrate the conclusions of the analysis into proposals for mandatory training of state prosecutors.
