The Association of Judges of Montenegro (USCG) condemned the reaction of the Independent Police Union after the Court of Appeal of Montenegro overturned the verdict of the High Court in Podgorica, which sentenced Ljuan and Ljuljzim Hasanaj and their mother Nura to 40 years in prison for the murder of police officer Milutin Leković. .
They characterized the reaction of the Independent Trade Union as offensive.
The USCG said that they respect the right of all citizens to express a critical opinion about the work of elected officials to the extent that this work is related to the performance of their function.
"However, in this particular case, it is not about reasoned criticism, which would be based on expert analysis, both when it comes to the factual situation and regarding the application of legal norms, but about the obviously inappropriate attitude of a trade union organization towards the judges of the Court of Appeal. that the judges of the Court of Appeal "again killed the police officer Milutin Leković and became accomplices in this heinous crime", the dignity of judges is being degraded in the most vulgar way, trying to present themselves as people without integrity and honor", said the USCG in a statement that signed by President Miodrag Pešić.
They point out that "the public can be very easily manipulated in relation to the actions of the courts, due to the specificity of the relationships that are the subject of review".
They called on all actors to refrain from "judging" through statements to the media, because decision-making in court proceedings is the exclusive competence of the courts.
"In this way, when it comes to specific court proceedings, on the one hand, the dignity of the tragically killed police officer Milutin Leković is protected, and on the other hand, it is easier for the court to properly determine the factual situation and make a fair decision in a lawfully conducted procedure," they said from An independent trade union.
They add that they are particularly worried by the statements of the Independent Trade Union that "all the talk, effort and work of honest, brave and loyal citizens and officials of our country in the fight against crime is in vain when every thug, drug dealer and murderer can have a case in the Montenegrin judiciary and prosecutor's office." "This is due to the fact that it is the duty of the police to protect and improve the safety of citizens, so if such "jataks" exist in the judiciary, it is the duty of members of the police to share this information with the competent state authorities and thereby contribute to the affirmation of the rule of law in Montenegro. , because, if such judges exist, they should not have a place in the Montenegrin judiciary," they said.
They say that the USCG supports judges to, regardless of pressures, difficult working conditions, continue to make decisions impartially, in accordance with the Constitution, ratified international treaties, laws and their own interpretation of the factual situation, in which way they will protect personal integrity, the authority of the institution to which they belong , but also the authority of the entire judiciary.
