Ivan Medojević and was officially dismissed from the position of director of the Agency for the Protection of Personal Data and Free Access to Information (AZLP), after the Council issued a decision on the dismissal yesterday. In the document submitted to the editorial office from the Council, in the context of the dismissal of Medojević, they cite files that do not actually concern his alleged conflict of interest, which is why the issue of his dismissal was raised.
The Council told Vijesti yesterday that they had appointed an acting officer at the session Čedomir Mitrović and left him the opportunity to express himself about it. Mitrović, however, told Vijest yesterday that he would not accept that proposal, but left the possibility of applying for the first man of the AZLP to the competition, when it is announced.
The Council also said yesterday that, if no one accepts that the acting to replace Medojević, the Agency for smooth operation also has an assistant director.
The public was informed about the dismissal of Ivan Medojević on December 21. The Council of the Agency made a decision yesterday.
In the decision, which was submitted by the Council at the request of "Vijesti", it is stated that Medojević was dismissed "due to the termination of fulfillment of the conditions for appointment" and that his employment contract is "cancelled" from April 27, 2020, ending on December 21, 12. 2023”.
They state that the procedure to determine the occurrence of circumstances that prevent the further performance of the director's function was initiated after the Council determined that Medojević's wife, Hana Medojević, in November was appointed as an adviser to the Deputy Prime Minister.
"At the Council session on December 19, 12, after Council members reviewed the decision on the appointment of Hana Medojević, conclusion no. 2023-01-50-19886/2 of December 23, 19, published on the Government's website, asked director Medojević to declare a possible conflict of interest. The Director of the Agency, Ivan Medojević, expresses his opinion by letter no. 12-2023-02-125/19887 dated December 1, 23, addressed to the President of the Council," the decision on dismissal states.
Medojevic previously said that he was given a deadline of three days to declare a possible conflict of interest and that he did not do so.
Yesterday, he told "Vijesti" that the letter 02-125-19887-1/23 dated 19 December 12.2023 was not his statement about a possible conflict of interest, as stated by the Council, but that the letter to the President Željko Rutović addressed in order to inform him about the way of acting and representation of the member of the Council of the Agency Zoran Vujicic.
In that letter, which "Vijesti" had access to, Medojević, among other things, recalls that the Agency for the Prevention of Corruption in relation to Vujičić "initiated a procedure to determine whether his actions endangered the public interest, which points to the existence of corruption ".
"And which refers to giving a recommendation to the non-governmental organization Građanska alijansa, whose former employee and now part-time employee, in terms of providing expert services, is Council member Zoran Vujičić", states Medojević in the letter that the Council presented in the decision on his dismissal as declaration of possible conflict of interest.
In the same document, it was stated that the Council, at its session on 21/12, "after duly receiving the director's statement and reviewing it, accepted the statement by a majority of votes".
"And after considering the contents, it was determined that in the same text the director did not deny the fact that his spouse was appointed by the Government... The Council... made a decision that the circumstances prescribed by law had occurred, which refer to the past 30 days, in accordance with the provisions of the Law on Prevention of Conflict of Interest", they state in the decision on the dismissal of Medojević. That session was attended by Vujičić and Muhammad Gjokaj.
The Law on the Protection of Personal Data stipulates that a person who is the spouse of a person who is a member of parliament or councilor, a member of the Government or a person appointed or appointed by the Government cannot be appointed as the president and member of the Council of the Agency. According to that Law, the same restrictions apply to the appointment of directors.
The same Law prescribes the conditions for the dismissal of the president or member of the Council, but not the manner and conditions for the dismissal of the Agency's director.
In the decision on dismissal, the Council refers to the conditions that apply to the president or a member of the Council, while Medojević claims that the Labor Law applies to the director of the Agency.
He previously said that his dismissal was not the first case of illegal dismissal of the director of AZLP, and that "citizens paid for these illegalities with their own money, over 50.000 euros, without establishing anyone's responsibility." In 2015, the Council dismissed it Bojan Obrenović, and appointed Čedomir Mitrović in his place.
The Montenegrin courts made a final decision that Obrenović was illegally dismissed.
Two days ago, Medojević called on the competent institutions to determine illegalities in the work of the Council.
