The Media Center (MC) invited the Directorate for Inspection Affairs/Department for Labor Inspection to check the legality of the procedure of hiring Vladimir Otašević to the position of acting director. of the executive director of RTV Podgorica (Gradska TV), it was announced today from that non-governmental association (NVU).
"On December 12, the council of this local public broadcaster made a decision on the appointment of the acting executive director, which, according to the MC, is not legal. Article 18 of the Decision on Amendments to the Decision on the Foundation of the Limited Liability Company Local public broadcaster Radio Television Podgorica, prescribes ( in the new article 48a) that 'in case of resignation or dismissal of the executive director, the Council appoints an acting person from among the employees of the Company who meet the requirements for the executive director and give written consent to the appointment'. According to the available information, the Council of RTV Podgorica did not receive records of persons who are already working at RTV Podgorica and who meet the conditions, nor are employees invited to apply for the position of acting executive director of RTV Podgorica and submit the necessary documentation," the MC statement signed by Dragoljub Vuković, president of the MC Assembly, points out.
The MC added that since the same article of the aforementioned Decision stated what should be done 'if the Company has no employees from paragraph 1 of this article', it was necessary to announce a public competition, but the Council of RTV Podgorica did not do so for reasons known to them.
"It remains unknown how and on the basis of which procedure Vladimir Otašević and Andrijana Kadija applied for the unannounced competition and on the basis of which the Council was able to make a decision," said the MC.
For MC, it is also disputed that the Council assessed that Vladimir Otašević has appropriate experience in management positions in areas relevant to the performance of activities.
"Is experience in the field of NGO work relevant for performing the function of director of RTV Podgorica, or should the candidate have management experience in a radio or TV broadcaster since he is applying for such a position? The MC concluded that Article 16 of the Decision on Changes was not respected when appointing Vladimir Otašević and amendments to the decision on the establishment of the limited liability company Local public broadcaster Radio Television Podgorica. This article clearly stipulates that 'a person who, in accordance with the law and Article 29 of this decision, cannot be a member of the Council cannot be appointed as executive director.' And a member of the Council cannot be someone whose spouses, common-law partners and life partners are share owners, shareholders, members of management bodies, members of supervisory bodies, employees or persons who are employed on another basis, persons under a contract and/or persons who have legal interest in legal entities, which are engaged in the activity of providing AVM services, access services and use of video exchange platforms, distribution of linear AVM services, as well as production of audiovisual content, advertising or electronic communications'. The MC hopes that the Directorate for Inspection Affairs/Department for Labor Inspection will use the powers prescribed by law and supervise the selection process of the executive director of RTV Podgorica.
