If the Municipality of Danilovrad agrees to the Environmental Impact Assessment Report, an industrial complex for the production of stone slabs could be built in the "Zeta" Nature Park.
The construction of the complex was planned by the company "Eco stone Jelenak", founded at the beginning of the year, and according to the Central Register of Business Entities (crps.me), it deals with cutting, shaping and processing of stone.
Locals of Luka, where the complex should be built on an area of more than 17.000 square meters, reacted strongly during the public hearing - they claim that the protected zone is being "industrialized" under the guise of the prefabricated building.
During the public debate on the Elaboration on Environmental Impact Assessment for the Project for the construction of a temporary building of an assembly hall with accompanying contents, the Institution of the Protector of Property and Legal Interests also made comments, pointing out that the content of the document "talks about a permanent facility, a production process with two production lines .
"Vijesti" is waiting for answers from the company "Eco stone". Executive Director Dusan Stojović he said to send the questions to the legal representative of the company, but the answers did not arrive last night until the conclusion of the text.
Construction of the factory started in August, then stopped
The story, according to the locals who contacted the newsroom, began back in August, when the Municipality of Danilovgrad announced "the start of work on the construction of a factory for the production of stone slabs".
"The beginning of the operation of the factory, i.e. the production of a unique ecological finished construction product using the most modern technology, is planned for the end of the current year," said the announcement, which was accompanied by a photo below the board with information about the project.
That information was soon removed from the official website of the Municipality of Danilovgrad, but it was uploaded by the local portal "Volim Danilovgrad", where it is still available today.
"Vijesti" was interested in that project back in September, but we were told by the Public Relations Department of the Municipality of Danilovgrad that "officials of the Danilovgrad Communal Police went to the site and performed additional control of the documentation submitted with the construction report by the company "Eco Stone Jelenak" from Danilovgrad".
"On that occasion, it was determined that the same company did not submit an Elaboration on Environmental Impact Assessment for the project in question, and the work on the site in question was suspended by the Municipal Police Service until the requested documentation was completed," the Public Relations and Protocol Service said at the time. .
They also said that the urban planning and technical conditions (UTU), i.e. the conditions for the preparation of technical documentation, were issued, as well as that they are in accordance with the Program of temporary buildings, as well as the Decision on the establishment of the Zeta River Nature Park, i.e. the permitted activities in zone III.
What can and what can't be done in zone III of protection
The Decision on establishment states that in the protection zone III of the Nature Park, the destruction of plant and animal species and their habitats, the disturbance of animal species during the reproduction period, the discharge of waste water and the introduction of polluting substances, the introduction of non-native species are prohibited.
In protection zone III, provided that they do not disturb the basic values of the area, interventions can be carried out with the aim of restoration, revitalization and overall improvement of the protected area, develop settlements and accompanying infrastructure, develop business-industrial and accompanying infrastructure, carry out works on the arrangement of cultural and historical heritage and traditional construction, selective and limited use of natural resources...
Because of all this, the institution of the Protector of Property and Legal Interests initiated proceedings before the Ministry of Spatial Planning, Urban Planning and State Property.
"...To assess the legality of the issued UT conditions, given that the spatial urban plan of the municipality of Danilovgrad, which covers the plots in question for that location, envisages agriculture and tourism, but not industry and the exploitation of natural raw materials. Proceedings have also been initiated before the Ministry of Agriculture for the purpose of supervision, given that it is very important to know that in this case it is agricultural land, as well as that there are seven registered agricultural farms in the immediate vicinity of the planned industrial complex, they told "Vijesta" ” from the institution he manages Bojana Cirovic.
Responding to the question of whether the fact that the zone III of the Nature Park is in question was taken into account, the institution of the Protector said: "If that fact had been taken into account, today we would not have reached the stage of public discussion on the Elaboration".
The institution of the Protector emphasizes that in the remarks on the Elaboration on the Environmental Impact Assessment for the project of construction of a temporary building of an assembly hall with accompanying contents "behind which an industrial complex with the production of stone slabs and boards is hidden", they pointed out the illegalities that accompanied that process.
"From the very issuance of UT conditions by the Municipality of Danilovgrad-Secretariat for Urban Planning and Environmental Protection. The same was pointed out to the mayor back in August, who has not taken any action until today... Protector Ćirović personally attended the public hearing organized by the Municipality and, orally, as a legal representative of the state, repeated that it was about the illegal issuance of UT conditions, in protected zone and pointed out that the state will take all the necessary measures to stop such behavior", replied the institution of the Protector.
What is written in the Elaborate
In the Elaborate, it is stated that the Secretariat issued UT conditions for the preparation of technical documentation for "Establishment of a temporary facility intended for the exploitation of natural raw materials, storage and production - assembly hall and hangar" on cadastral plots 606, 607, 608, 609, 610, 611 and 612 KO Jelenak. It is specified that it is about the production of stone slabs.
"The location in question, where the proposed temporary building is planned, covers an area of about 17.377,39 m2. The listed cadastral plots are located within the scope of the "Zeta" Nature Park and belong to the III protection zone. The course of the Zeta River itself is about two kilometers away," the document states.
It is also stated that the Temporary Facilities Program of the Municipality of Danilovgrad allows the installation of assembly halls and hangars in that zone.
"The facility of the hall has a high ground floor. In the immediate vicinity of the plots, on the northern and eastern sides, there is a local road, from which, on the eastern side, a connection to the hall is formed.... production hall, building with wardrobes and restaurant, aggregate separation facility, water tank, existing facility... The main - production part of the complex, which is located in the northern part of the site, together with supporting facilities - restaurant, aggregate separation and water tank, which connects the common plateau", it is stated in the Elaborate.
Dust, destruction of roads, noise...
In the remarks of the Protector's institution, submitted to the Danilovgrad Secretariat for Urban Planning and Environmental Protection, it is stated that "the UT conditions for the preparation of technical documentation for the installation of a temporary facility intended for the exploitation of natural raw materials, storage and production (assembly of halls and hangars) are illegal". It is also emphasized that the Program of temporary facilities must not exceed the spatial and urban plan.
"The defender has already pointed to the relevant legal regulations, considering that it is zone III of the 'Zeta' nature park, agricultural land, which zone is covered by the Danilovgrad Spatial Urban Plan, which does not allow the construction of temporary facilities for the exploitation of natural raw materials, storage and production", it is stated in the remarks, which "Vijesti" had access to.
It is stated that from the Elaborate it follows that the project location is reached by a local asphalt road, while the connection to the location itself is via a shorter macadam road.
"It follows that the expert team did not go to the scene, because there is no data on the condition of that road, but they very skillfully did not state that the Sige-Luke-Gostilje road is in question, which is in a very bad condition, and which, and that in at best, the production that this company plans to start illegally is a factor in the destruction of that road. It is about road infrastructure that certainly cannot be used for the purposes of serving the production process. It should be noted that the surrounding plots bordering the site are used by residents of Luka for grazing livestock, while in the immediate vicinity of the stone slab factory there are as many as seven registered agricultural farms", the remarks state.
The canopy-separation of aggregates is, according to the remarks, a covered space in which aggregate stone will be stored.
"...So from unloading it, standing in all possible weather conditions, the dust will be able to spread freely, and children and people living in the immediate vicinity will be able to freely inhale the harmful dust, which will shower both plant and animal life ... The construction of the planned industrial hall corresponds to the conditions provided by industrial zones, not special protection zones. However, the annual production plan presented and the amount of raw materials that will be used on a daily basis show that Eco stone does not plan to use this hall/complex temporarily", the remarks of the Protector's institution emphasized.
