The non-governmental organizations Parents, Civil Alliance, ADP Zid and 4 Life submitted a complaint to the Ministry of Education of Montenegro for violation of the rules of procedure, i.e. silence of the administration.
"Since no decision was made within 15 days, in accordance with Article 31 of the Law on Free Access to Information, we proposed that the Council of the Agency for the Protection of Personal Data and Access to Information conduct the procedure and order the adoption of a decision. We consider the attitude of the Ministry of Education towards the non-governmental sector in in this case, ignoring requests, which is not conducive to good communication and cooperation between state institutions and the civil sector. cooperation with the interested public. Due to the impossibility of exercising the right of civil society organizations to access information, the Agency for the Protection of Personal Data and Access to Information assumes responsibility for further proceedings in this case," states the statement signed by the NGO.
They remind that the Parents' Association, Civic Alliance, ADP Zid and NGO 4 Life submitted a request for free access to information to the Ministry of Education on July 7, and to the regency on July 27, requesting that they be allowed access to candidate biographies, institution development programs, as well as the Report of the adviser in the Ministry of Education on the submitted documentation of the candidates who submitted applications for the election of the director of the Public Prosecutor's Office "Đina Vrbica".
"According to Article 10, paragraph 2, of the Law on Free Access to Information, "the right to access information includes: the right to request and receive information, regardless of the purpose and data contained therein", and according to Article 13 of the same Law, the authority is obliged to provide the applicant with access to the information or part of it. We note that according to the provisions of Article 31 of this Law, the authority is obliged to make a decision on the request for access to information and deliver it to the applicant within 15 days from the date of submission of the request." it is stated in the announcement.
