The management of the Montefarm Pharmacy of Montenegro claims that the subject of the cession can be both existing and future claims.
This was announced by "Montefarm", referring to the article "Vijesti" about the fact that at the end of 2022, that institution took over the debt of the drugstore "Medicalana" in the amount of 80.000 euros to a commercial bank, although at that time, according to the documentation, it did not have no debts to that private company.
"Vijesti" cited the findings of the State Audit Institution (DRI), which determined that the cession agreement was concluded without complete, credible financial documentation, that is, that payment by cession should be preceded by a debtor-creditor relationship.
"Due to media interpretations of the term cession, at the beginning let's immediately clarify that according to the definition, the subject of cession can be existing and future claims, and the basis for signing the same, as we clarified, were contracts No. 7-1722 of 22.06.2022. and No. 8a-4822 dated 30.11.2022. The goods were continuously delivered, we extended the payment term from 90 to 180 days by assignment, in six equal installments and the first installment based on the Assignment Agreement was paid on January 25.01.2023, 13.086,34. in the amount of XNUMX euros", they stated.
"Montefarm" said that the contracts were signed and implemented based on public tender procedures from 2022, while the cession enabled better liquidity and continuity of deliveries from suppliers in the amount of monthly installments.
"The existing documentation was made available for inspection and presented to the auditors of the SAI, and there is no qualification in the official report of the same that there was no debtor-creditor relationship on the day of signing the cession on December 27.12.2022, 7, because the very signing of contract No. 1722-8 in June and No. 4822a -2022 in November XNUMX. "Montefarm" committed itself and entered into a debtor-trustee relationship, which the DRI experts should be familiar with, in accordance with the provisions of the Law on Obligations", claim from "Montefarm".
They conclude that "it is an undeniable fact that Montefarm did not pay the debt of a private wholesaler, but its own, based on the existing contracts signed in 2022".
From the institution he manages Goran Marinović, they said that during 2022, "Medicalana" had a share of 0,4 percent in the total turnover of drugs and medical devices, but also that it delivers only medical devices, for which it is registered.
"DRI carried out the control of Montefarma's operations in 2010, but in the report on operations in 2022, it did not state or clearly emphasize that certain remarks were noted even then. The report from 2010 contains a series of recommendations, which in the meantime... have not been corrected, and the question arises as to how the audit of finances and operations at that time was rated as conditionally positive. If there are doubts, we are ready to make both reports available to the public at any time", they stated.
