Signing 63 contracts for an indefinite period contrary to the Rulebook on Systematization, advertising of pharmaceutical products contrary to the Statute and without consent, retroactive signing of work contracts without an institution number, signature and specified professional qualification, are just some of the irregularities found by the Commission of the Ministry of Health, controlling the work of the director "Montefarma" Goran Marinović.
"Vijesti" had insight into the request for a statement from the director of "Montefarm", which is the Minister of Health Vojislav Šimun addressed to that public institution last Friday.
The Commission for the Control of the Work of Health Institutions, which was founded by the state, found, as stated, numerous irregularities in the work of that institution and drew up a report on March 5, in which it informed the minister that Marinović had acted contrary to the Law on Health Care, the Law on Labor , Rulebook on closer conditions for performing additional work, but also that he did not respect the Statute and the Rulebook on the systematization of workplaces.
Marinović announced yesterday that, according to the Statute, he can only respond within 30 days, and by no means within seven days, as the Ministry of Health demanded.
Lease and advertising without consent and approval
Šimun asked Marinović for an explanation as to why he hired a lawyer to perform legal work with a monthly fee of 950 euros, when the institution has a Sector for Economic-Legal and General Affairs in which several lawyers are employed whose job description is performing legal work. The documentation states that, according to the annex to the contract from May 2023, the lawyer will be paid 950 euros, while he will be paid a fee according to the lawyer's tariff for the performance of legal work.
The Ministry questioned several lease agreements, cession agreements, loan agreements, and LED display installation agreements, as well as consulting services.
According to the documentation, Marinović signed several contracts on the use of space on smart LED displays/3D holograms, although the statute of the institution does not provide for the activity of advertising pharmaceutical products and he did not have consent for that.
The Commission also established that several contracts on supplementary work were concluded retroactively. For some contracts, it is stated that they were concluded with persons in the business of assisting the sale of medicines, dietary products and medical cosmetics, and the professional qualification is unknown from the documentation. Some of the contracts, the report says, do not have an institutional number, seal and signature of directors and employees.
In one contract on the commission sale of goods, it is written that the sales range and the price of the goods are determined by that contract, however, the sales price is not written in it.
For several contracts for the procurement of services, Šimun asked for a statement, among other things, on whether he had the approval of the Board of Directors for the purchase agreed by contract with a company from Belgrade whose business is vehicle trading.
According to the controller's assessment, Marinović concluded several contracts for the lease of business premises without the decision of the Board of Directors and the approval of the Ministry of Health, contrary to the Institution's Statute.
The commission stated that the assistant director in v. d situation for over six months and that by not advertising the position, Marinović did not allow other interested candidates to apply for that position, which is contrary to the Labor Law.
Disputed employment in "Montefarm"
In Minister Šimun's request, which "Vijesti" had access to, it is stated that Marinović as a manager concluded 63 contracts for an indefinite period last year and did not comply with the Rulebook on the systematization of workplaces. It is claimed that the contracts did not define trial work as a special condition when establishing an employment relationship, and in the preamble of the decision on the selection of candidates, he did not refer to the Employment Regulations, although in the explanation he states that he interviewed the candidates.
"It was not established that you evaluated the candidates (their level of knowledge, abilities and skills), as defined in the Employment Regulations," the request reads. For one of the employees, it is stated that the employment contract for an indefinite period was concluded on January 1 - Sunday, a non-working day, so the contract was concluded in violation of general legal norms and violated the Law on State and Other Holidays.
According to the document, "Montefarm" also hired workers through an agency, which was paid a total of around 2023 million euros for regular work in 1,35 for wages and personal income. Analytical cards show that about 1,5 million euros were paid to that agency last year from "Montefarm". The control showed that the financial plan did not provide funds for the engagement of an employment mediation agency, as well as in the Public Procurement Plan of the institution for 2023.
Marinović yesterday, reacting to the allegations of the Ministry, announced that he was considered to have been employed outside the Rulebook from 2017, which the same Commission notes was not signed by the Board of Directors, but by the previous director. He said that in 2023, 303 sick leaves were opened in that institution, which was the main motive for employment and loans through agencies.
The Ministry of Health also asked Marinović for a statement regarding decisions related to payments to employees due to increased workload, work, participation in commissions and incentives. They assessed that such decisions were unfounded, they do not contain an explanation of the scope of work for which employees are stimulated, and some were paid fees of 300 euros for membership in the commission formed by the Ministry of Health. Yesterday, Marinović assessed that the figure of 200.000 euros is, in his opinion, the minimum compensation for the contribution to the business results of the institution to different individuals, in the amount of 50 to 250 euros, for results achieved in a very short time.
Almost 41.000 euros for national teams
The commission, among other things, analyzing the report on the realization of the financial plan until 31.12.2023 December 135.320.907,95, determined that a total of 96,55 euros was realized, which is 8,3 percent of the annual plan. It states that about 23 million was spent on gross wages and contributions, that is, almost 6,9 percent more than planned. The report states that a total of 1,35 million was paid for gross wages for regular work and other payments (additional work, parapharmacy, transportation, commissions and incentives), and that amount is higher than planned, but it is also more than that to the mediation agency in employment paid a total of about XNUMX million for gross wages for regular work and other personal income.
In the report, among other things, it is written that 9.000 euros were planned for the expenses of the national team, and 40.955 euros were spent. 3.000 was planned for professional development services, and 41.196,42 euros were spent, i.e. 1.273 percent more than the plan.
It is also stated that 35.557 euros were paid for media services and promotional activities, although 10.000 were planned.
The director of "Montefarm" was asked to comment on the report on the audit of the annual financial report and regularity of operations for 2022, and about thirty findings.
Marinović: Awarded 12 gross salaries for 33 months of management
"Vijesti" announced yesterday that Marinović was recently awarded a 20.000 euro bonus for good business performance, based on the minutes of the Management Board, which were not adopted and which the new Management Board overruled.
Yesterday, Marinović, reacting to these allegations, said that "titles that sound tempting to laymen, and which emphasize the amount of 20.000 euros allocated to the director based on the decision of the Board of Directors and representing 0,7 percent of the total realized profit, need to be clarified."
