According to the Law on the Prevention of Corruption, the director of the Agency for the Prevention of Corruption (ASK) - whoever he is - is the only one authorized to decide on all wages and salary allowances paid from the institution's budget. That is the only thing that is relevant in this whole fabricated affair, ASK announced.
From that institution, they pointed out that it is not uncommon for "one who is not sure of his actions to raise his voice in public, trying to exert media pressure and create the image that he is working legally".
They added that this is why they are not surprised by the behavior of the Budget Inspection "to first inform the media about its legal actions, and only then those to whom these actions refer".
"Integrity implies legal, independent, impartial, responsible and transparent performance of public administration duties. Dear citizens, the Constitution of Montenegro guarantees every citizen of our country, including the director of the Agency for the Prevention of Corruption, Jelena Perović, the right to a legal remedy against the decision about his or her right or interest based on the law. From March 20 to April 2, neither Director Perović nor the Agency were given the opportunity to file a complaint against the actions of the Budget Inspection, which persistently and unsuccessfully tries to explain to the public that it is working legally cannot, in the manner prescribed by law, receive earnings. During this time, the Ministry of Finance is showing unprecedented arbitrariness, putting itself above the legal system and showing that anyone can be deprived of a part of earnings, without a solution and the right to a legal remedy. It seems that it is enough only that you don't like someone. With this, these state authorities are trying to establish arbitration as the supreme legal principle. According to the Law on the Prevention of Corruption, the director of the Agency - whoever he is - is the only one authorized to decide on all wages and salary compensations that are paid from the institution's budget. That is the only thing that is relevant in this whole contrived affair. That right, on which the Agency's financial independence is based, will not be taken away from us by anyone," the announcement reads.

KAS pointed out that they recommend the Budget Inspection and the Ministry of Finance to return to the institutional framework and to obtain final judgments in criminal and civil proceedings.
"In them, we have no doubt, the illegal behavior of those who take away the rights of others by denying them the right to a legal remedy will be determined," it is stated.
"In the end, the goal of the disclosure of documents from the Ministry of Finance and the Budget Inspection is certainly not the use of the principle of prevention from the Law on Inspection Supervision, but the lynching of a woman. A woman who is close to legal issues, and who is ready to defend her right - and therefore the right of all citizens - and the integrity and independence of the institution headed by him," the announcement concludes.
