MIlivoje Katnić must return 11.525,67 euros to the state, with legal interest, because in 2017, as the then chief special prosecutor, he was responsible for the damage caused by the violation of the lawyer's personal rights Goran Rodić, Siniše Gazivode i Marije Radulović.
This, "Vijesti" learns, is stated in the first-instance verdict of the Podgorica Basic Court, which is signed by the judge. Sanela Efović.
The state sued Katnić in October 2022, after three lawyers received a final verdict that the Special Prosecutor's Office violated their privacy rights, because in July 2017 it published a statement and accompanying document on its website, entitled "Special State Prosecutor's Office represents the forms of special war".
The state paid more than 2022 euros to Rodić, Radulović and Gazivoda in February 11.500 for violating the right to mental integrity, honor, reputation, protection of private life, personality, dignity, as well as correspondence and personal records.
"The claim is approved, so the defendant is obligated to pay the plaintiff the amount of 11.525,67 euros, with statutory default interest from February 25.02.2022, 15, in the name of recourse compensation. year, and until the final payment, within XNUMX years from the date of finality of the judgment, under the threat of forced execution", reads the judgment of Judge Efović, which "Vijesti" had access to.
Judge Efović is of the opinion that Katnić, as the chief special prosecutor, could have sought the protection of the administration of justice, himself and the institution in another way - in an appropriate court procedure.
"Instead, he decided to illegally publish on the website of the Special State Prosecutor's Office the telephone communication between lawyers Goran Rodić, Siniša Gazivoda and Marija Radulović and their clients, without their consent, which was accompanied by the aforementioned comments and conclusions, which all indicate that the defendant, when publishing the disputed notice, acted with the intention of causing damage to the mentioned persons in the form of a violation of personal rights," the judgment states.
In the verdict, it is stated that Katnić claimed that "as the chief special prosecutor, he did not act illegally, unprofessionally, and especially not negligently", but that "unfortunately, by a criminal verdict, and then by a civil one, it was found that he was illegal".

"In the case presented, the court finds that the conditions for the defendant's responsibility are met in terms of the provisions of art. 166 st. 2 of the Law on Obligations and Art. 102 paragraph 2 of the Law on State Prosecution for which reasons obliged the defendant to reimburse the plaintiff in terms of the cited legal provisions the amount of EUR 11.525,67 that she paid on 25.02.2022/2595/20. year, to the parties (executive creditors) Goran Rodić, Siniša Gazivoda and Marija Radulović according to the decision of the public bailiff..., which was made on the basis of the enforcement document of the judgment of the Basic Court in Podgorica P. no. 13.04.2021/4555 of April 21, 18.01.2022 with the judgment of the High Court in Podgorica Gž. no. 25.02.2022/284 of January XNUMX, XNUMX. According to the court's opinion, the amount of compensation awarded to the plaintiff (the state) also includes statutory default interest, starting from February XNUMX, XNUMX. year, as the date of payment of the specified amount, and until the final payment, in accordance with the provisions of Article XNUMX of the Law on Obligations", the judgment specified.
Katnić is the first former official to whom this sanction was determined by a first-instance verdict due to the damage caused by the institution he headed.
The state is currently asking the courts that the former Minister of Education, Science, Culture and Sports compensate for the damage to the budget. Vesna Bratic, which signed dozens of dismissals of directors of educational institutions in 2021. Most of them sued the state, and the courts ruled that the decisions on their dismissal were illegal, which is why they have been paid about 300.000 euros so far.
The Institution of the Protector of Property and Legal Interests, which represents the state, also demands from the director of the Agency for the Prevention of Corruption Jelena Perović to return almost 60.000 euros as the difference between the price at which she got the apartment on preferential terms and the market price of that property.
Katnić was arrested on April 14, and in the same action, a long-time secret and public police agent and former assistant director of the Police Administration was deprived of his freedom.
