Director of Maritime Property Mladen Mikijelj was not in a conflict of interest when, in July 2021, he transferred 40.000 euros of donations from the account of that state-owned enterprise to the "Petrovac" football club, in which his two brothers are employed, claims the director of the Agency for the Prevention of Corruption (ASK). Jelena Perović.
In 2022, the Agency launched an investigation after a report of suspected violation of the Law on Prevention of Corruption, ended it in November last year, and published it on its website only recently.
In the report, it was stated that Mikijelj, as the director of Morski Dobr, in July 2021, paid the amount of 40.000 euros as a sponsorship to FC "Petrovac" from the account of that state enterprise.
In that club are the brothers of the director of Morski Dobr - Zoran i Aleksandar Mikijelj, one is an active football player, while the other is the director of the club, which is why the applicant believed that Mladen Mikijelj subordinated the public interest to the private one.
According to the anonymized decision, in the proceedings before the KAS, he stated that he did not violate the Law on Prevention of Corruption, nor that he subordinated the private interest of his family to the public one, because the decision to give the football club where his brothers are a player and director was not brought by him personally, but by the Management Board of the Maritime Property.
The management board, Mikijelj claimed before the Agency, did this on the basis of a request for sponsorship of 50.000 euros, which FK "Petrovac" submitted to that state-owned company in the summer of 2021.
According to the decision, Mikijelj also submitted to the ASK the internal rulebook of the Maritime Property on the method of giving and determining the criteria for giving donations, sponsorships, advertising and business cooperation, financial and other assistance from May 13, 2021.
FC "Petrovac" submitted a request for sponsorship on July 19, 2021, and the Board of Directors of the Maritime Property, then chaired by Blažo Radjenović, approved it on July 30.

Mikijelj stressed that only the company's Board of Directors is competent to make decisions on sponsorships and individual assistance worth more than 1.000 euros, and that he, as a director, did not participate in this when it came to the request for sponsorship of the football club in which his two brothers were employed. .
"It is established that public functionary Mladen Mikijelj did not violate Article 7 and 8 of the Law on Prevention of Corruption because he did not subordinate the public interest to the private and did not cause a conflict of interest in the exercise of his public function", it is written in the decision that was finally made on this matter on November 20 last year ASK, signed by Perović.
"After evaluating the evidence presented... and the statement of a public official, the Agency determined that Mladen Mikijelj did not violate Article 7 and 8 of the Law on Prevention of Corruption because he did not participate in the decision-making and making of the decision to grant sponsorship to FC 'Petrovac', thereby not subordinating the public interest private and did not cause a conflict of interest in the performance of a public function, to which evidence the Agency gave full faith, valuing them as clear and true, which is also confirmed by Article 7 of the cited Rulebook, which stipulates that it decides and makes a decision on donations, sponsorships and assistance in the amount of more than 1.000 euros The Board of Directors of the Public Enterprise", assessed Perović.
