On August 16, the Parliamentary Committee for Education, Science, Culture and Sports will consider the Proposal for Amendments to the General Law on Education, according to which the school year will have two classification periods - two semesters, and the appointment and dismissal of directors will return to the competence of the minister.
On the same day, on amendments to the General Law on Education proposed by PES MPs Jelenka Andric, Branka Markovic, Nadja Laković i Darko Dragović, other representatives of the citizens will speak during the session of the fourth extraordinary session.
At the end of June, the Government gave its consent to the proposed amendments, and the Ministry of Education, Science and Innovation said at the time that the proposed solutions would improve the situation in this area and eliminate certain doubts or problems that had been recorded in the past period...".
From the department he manages Anđela Jakšić-Stojanović, have repeatedly warned that school boards often turn a deaf ear to the proposals of the Educational Inspection for the dismissal of the principal, which is why the MPs estimated that they must return that authority to the Ministry.
According to their proposal, the minister is obliged to appoint the first-ranked candidate as the head of the educational institution, after the checks have been carried out. The possibility of choosing the second-ranked or third-ranked candidate is left, but the minister must justify such a decision.
The proposal for changes to that regulation does not provide for the dismissal of the current directors of institutions, as was the case in 2021, which is why the state should pay at least 300.000 euros to the dismissed managers, because the courts in most cases annulled the decisions on their dismissal as illegal.
"Procedures for the election of principals started before the entry into force of this law will be completed according to the regulations by which they were started," reads the proposal for changes to the General Law on Education, to which the Government of Montenegro gave a positive opinion at its session on Thursday.
The proposal for changes stipulates that a person with at least five years of teaching experience can be elected as the director of the institution.
The competition for the election of directors, the document states, must be announced three months before the end of the mandate of the current manager.
It is specified that candidates who submit proper documentation to the competition are subject to a check of competence, knowledge and abilities.
"Verification is carried out through a written test and an oral interview based on prescribed criteria. The inspection is carried out by a commission formed by the minister. The committee consists of: a representative of the Ministry, a representative of the Institute for Education, i.e. the Center, and one external member, from among prominent experts in the field of education for which the director is elected. The external member is appointed by the minister from the list of prominent experts. The list of distinguished experts is formed on the basis of a public call. An external member can be a person employed in an educational institution who has at least: the seventh level of educational qualification and at least seven years of work experience in teaching, of which, as a rule, at least three years in a managerial position in the field of education", the document emphasizes and adds that the detailed method of conducting the check, the criteria and the method of evaluation, as well as the method of compiling the list of candidates for the election of directors, shall be prescribed by the Ministry.
The structure of the school, i.e. administrative boards, will also be changed, so depending on the level of education, they will have from three to five members.
According to the proposed changes, the school, i.e. management board of pre-school institutions, elementary schools and high schools, will have three members, and it will be made up of a representative of the Ministry of Education or the municipality if it is the founder, a representative of employees and a representative of parents.
School boards of secondary vocational schools will consist of two representatives of the Ministry of Education or the municipality if it is the founder and one representative each of employees, social partners and parents.
