At the request of the citizens, the construction and urban inspection stopped the works on the construction site of the investor "Invictus formo" in the Ilino settlement in Bar because he did not have a building permit. Neighbors who live close to the construction site reported him because they believe that he does not comply with urban planning and technical conditions. He claims the opposite and announces a lawsuit against them because they entered his plot.
As the Ministry of Spatial Planning, Urbanism and State Property told "Vijesta", the inspection carried out an inspection on August 20, during which the responsible persons were not present, and the inspector left an invitation to the investor to declare himself in the official premises of the Ministry, which he did on August 22 and submitted part of the documentation. After reviewing the submitted documentation, the inspector determined that the construction report had not been submitted, even though the works had already started.
"Therefore, a decision was made to ban further construction works until the necessary construction report is received, which the investor submitted only on August 21, 2024, after the first inspection," the relevant ministry said.
They emphasized that the inspection is carefully monitoring compliance with the construction ban on this construction site and, in case of non-compliance with the ordered measures, will take additional measures of misdemeanor liability, including the possibility of filing criminal charges.
The consent of the Chief State Architect, signed by the then acting Siniša Minic, was issued for a preliminary architectural solution, which includes a basement in which there will be an underground parking lot, a basement, a ground floor and four more floors.
Residents of Jugoslovenska Street, where the construction site is located, said that they spoke with the investor, and that he informed them that the building would look exactly like that. However, they claim, the reality is different, and the basement and basement are at the level of the ground floor and not as presented on the construction board. In addition, the building is being built in zone J in Ilino, which is provided for in the Detailed Urban Plan of Ilino, Bar. In that plan, the urban technical conditions for construction are prescribed, which are valid for the entire zone. In the document that stipulates these conditions, it is written that in this zone the minimum distance from the border of the neighboring urban plot is a quarter of the building's height, but it cannot be less than three and a half meters. If neighboring buildings contain openings for daylight, i.e. windows and balconies, on the side facing the new building, the distance cannot be less than four meters.
The building can be placed at a shorter distance or on the very border of the urban plot if the neighboring buildings used for housing do not have windows and the owner of the neighboring buildings gives written approval.
Residents of Jugoslovenska Street with whom "Vijesti" spoke said that the real distance of the first wall of the building from their plots or houses is less than a meter. They claim that they never gave the mentioned consent to move closer to them, nor did the investor ask them to.
An inspection of the documentation concludes that these are regulations for multi-storey buildings and buildings that are used as business and residential. When it comes to a garage or storage building that does not have openings for daylight, that is, windows, it can be brought closer to another plot so that it does not endanger the neighboring building.
"Most of us adhered to these conditions during the construction of our houses. Some of us wanted to build apartments, that is, tourist housing facilities, such as this building, but we simply could not meet these conditions because everything was compacted, so we did not build. It seems that the rules are not the same for everyone," said a Baran resident who lives in the immediate vicinity of the construction site.
Citizens are the most suspicious about the aforementioned basement and cellar, which was announced as underground, and they believe and assess that this part is completely raised above ground level, and not below. They said that they hope that the closure of the construction site is not only a temporary measure to appease them, but that they will thoroughly and seriously devote themselves to this case because, as they said, there are numerous irregularities.
Vlasnik says “Invictus formo” Peđa Despotović He told "Vijesta" that everything is according to the regulations, that the construction permit that was subsequently submitted was an oversight by the company in charge of supervision. Despite this, he claims, the permit is valid and submitted to the inspection, after which his company was approved to continue with the work from Monday by the relevant ministry.
According to the documentation that "Vijesti" has access to, he received that decision on August 29, in which it was determined that there were no more irregularities and that the previous ones had been corrected.
He pointed out that he has settled all obligations to the Municipality for communal equipment of construction land in the amount of almost 60 thousand euros, for which he also submitted documentation, as well as to the Regional Waterworks for over 48 thousand euros.
He said that he fully complied with regulations and urban technical conditions when it comes to the proximity of the garage, basement and floors. He had good communication and cooperation with his neighbors, he said, so he was surprised by their reaction and report to the inspection.
Because of this, he decided to do something about it, he took a surveyor to the field who determined the irregularities and also informed himself about how well his neighbors respect the regulations.
"None of them have a building permit, without exception. They never paid a cent for utilities or any connection. All of them, without exception, entered my plot from 30 to 70 centimeters and soon my lawyer will contact them with a request to remove the objects or pay compensation. Otherwise, a court process will be initiated with the same demands," he said.
