The Government Appeals Commission found that the secretary of the Secretariat for Financial Affairs and Budget Analysis of the Capital City, Balša Špadijer, was illegally appointed to that position, and his work experience was challenged.
According to the decision of October 10, which "Vijesti" had access to, the Commission assessed that outgoing mayor Olivera Injac, in the process of appointing Spadijer, did not properly determine the factual situation and that "legal procedures were not taken into account."
Spadijer has been at the head of the Secretariat since 2023 as an acting officer, and Injac appointed him for a full term on July 26 of this year.
In the last Podgorica elections, he was a candidate for councilor of the list "For a better Podgorica - Jakov Milatović" (Movement for Podgorica, Movement for Changes and Civil Movement URA).
In addition to Špadijer, Dragan Bulatović, Jela Mrdak, as well as Sandra Marković applied for the vacancy for the secretary of the Podgorica Secretariat for Finance, who, according to the decision, was informed that she did not meet the conditions of the competition.
Both Mrdak and Bulatović complained about the decision of Injac and the choice of Špadijer.

The commission pointed out that the disputed procedure of the procedure that preceded the adoption of the INAC decision on the appointment of Spadijer as secretary.
"In the previous decision, this Commission stated that it is disputed whether the selected candidate met one of the special conditions stipulated in the public competition for filling the position - eight years of work experience in the same or similar jobs in relation to the jobs of the position for which the competition was announced , that is, whether he submitted valid certificates or certificates of the necessary work experience at the level of education qualification. Namely, in the public competition, it was specified that the proof of work experience is considered to be a certificate or a certificate of the necessary work experience at the level of the educational qualification", reads the decision of the Governmental Appeals Commission, which "Vijesti" had access to.
In that document, it is also stated that the confirmations submitted from the banking sector did not specify the jobs that Spadijer performed in commercial banks.
"Proceeding from the above, according to the Commission's assessment, it was not possible to determine with certainty from the attached documentation whether the selected candidate fulfills the special conditions prescribed by the subject public competition in terms of the necessary work experience," the decision reads.
The Secretariat for Local Self-Government and Cooperation with Civil Society required Spadijer to complete the documentation of the public tender, for which there was no legal basis.
"... With regard to the necessary work experience to perform the duties of the advertised position, he, acting on the above request, submitted the certificate of the Secretariat for Local Self-Government and Cooperation with Civil Society no. UV 06-105/24-62 dated June 26.6.2024, 3. that Balša Špadijer was appointed as the acting secretary of the Secretariat for Financial Affairs and Budget Analysis of the Capital City starting from 7 July 2023, whereby on 15 January 1 he gained six months and 2024 days of work experience with VII 12 by the level of education qualification...", the document says.
In the decision of the Government Appeals Commission, it is also stated that Špadijer, with the VII 2013 level of educational qualification, worked in several commercial banks and companies as a referrer in the period from 2024 to 1.
"Starting from the factual situation established in the proceedings before the first-instance authority, and bearing in mind the cited legal norms, according to the order of the Appeals Commission, annul the first decision of the mayor of Podgorica on the appointment of the secretary of the Secretariat for Financial Affairs and Budget Analysis of the Capital City no. 01-018/24-1201/1 dated March 1, 3, did not require the selected candidate to submit new evidence of fulfilling the required work experience," the document states.
