The Office of the Protector of Property and Legal Interests in Bijelo Polje, as the injured party in the case of illegal construction and illegal occupation of state property in the town of Gubavac next to the Bistrica River, filed a complaint with the Higher State Prosecutor's Office due to the rejection of six criminal charges in that case.

State prosecutor Danijela Đuković she repeated for "Vijesti" that the Basic State Prosecutor's Office submitted an indictment against six persons, while in the case of six, it issued a decision to dismiss the criminal charges. 15 people were heard in that case.
In the Basic Court's response to "News", they stated that the Basic State Prosecutor's Office submitted an indictment to that court against HM, HE, IA, and IH for the criminal offense of building a building without registration and documentation for construction on October 9, and that five days later it submitted indictment against ZZ for the same criminal offense.
"A plea agreement was also submitted to the court, and the hearing is scheduled for November 4," they state from the Basic Court, reminding that the decision based on the agreement is made only after the hearing.
The Office of the Protector of Legal Interests announced that they also approached the Ministry of Spatial Planning, Urban Planning and State Property - Urban Construction Inspection on October 14, to take competent actions and asked them to carry out an inspection, and that after the established factual situation, the competent inspection ordered the removal of those buildings, temporary structures, waste material from plot 734 registered on LN number 136 KO Gubavac, as well as other plots registered in title deeds 63 and 24 KO Voljavac.
Euromost states that after they informed the public that one of the indictments was filed against them Zita Zvrka, the father of the president of OO DPS and a councilor in the Bijelo Polje parliament Elvira Zvrka, who, as stated by the "real owner of the plot", and after signing the plea agreement with his father, informed the Supreme State Prosecutor's Office, the Special State Prosecutor's Office, as well as the Higher State Prosecutor's Office in Bijelo Polje, to whom they submitted all the evidence that organization collected, in which, as they claim, it is clearly seen that Elvir Zvrko's father had nothing to do with the committed crime, nor did he appear anywhere in the evidence, but in the entire case and evidence, his son Elvir Zvrko, who was also suspect in this case.
"It is surprising that the acting prosecutor could sign any agreement with his father", they state and say that is why they asked the Basic Court to reject such an agreement, and the authorities to investigate whether other criminal acts were committed in this case.
Elvir Zvrko said that he stands by his earlier statement to "Vijesta". He then said that everything that was done in that area did not in any way threaten the bed or the biodiversity of the Bistrica river, nor did it have any harmful effect on the river.
"On the contrary, the water flow has been improved, the river and the area around it has been improved and improved," said Zvrko.
He called on the competent authorities to establish all the relevant facts.
"Unfortunately, the story about the Bistrica river in such a small area is obviously politically motivated and does not deserve my comment, so I will no longer publicly advertise on this issue," he said.
Lawyer of the president of Bjelopolje DPS Amer Šukurica he previously denied allegations that the Basic Prosecutor's Office in Bijelo Polje filed an indictment against him due to illegal construction next to the Bistrica River.
In his response, Šukurica stated that no proceedings are being conducted against Zvrk before the Basic Prosecutor's Office in Bijelo Polje, nor has it submitted an indictment against Zvrk to the Basic Court in Bijelo Polje, and that it is unverified and tendentious information from certain non-governmental organizations, which can be easily checked with the competent authorities.
Non-governmental organization Euromost, on whose initiative the proceedings before the prosecutor's office were initiated more than a year ago, point out that the greatest responsibility lies with the state institutions, because even after their public warnings, the construction continued, that is, some buildings were completed.
