The Media Center submitted an invitation to the Supreme State Prosecutor, Milorad Marković, to, in accordance with the Law on State Prosecution, issue mandatory instructions for the work of the competent prosecutor in connection with proceedings for non-compliance with court rulings, which are based on criminal charges filed by the Media Center.
"As we believe you are aware, on June 8, 2023, the Media Center filed criminal charges against the president and members of the RTCG Council: Veselin Drljević (president), Filip Lazović, Naod Zorić, Predrag Miranović and Amina Murić because, as public officials, refused the execution of a legally binding and enforceable court verdict and enabled the acquisition of illegal benefits to the illegally elected general director of RTCG Boris Raonić, thereby committing the criminal offense of non-execution of a court verdict under Article 395 and the criminal offense of abuse of official position under Article 416 of the Criminal Code of Montenegro," it says. in a statement signed by the President of the Media Center Assembly, Dragoljub Vuković.
He states that on the same day they filed criminal charges against RTCG General Director Boris Raonić, RTCG Legal Service Manager Želimir Mićović and RTCG lawyer Zorica Đukanović, because they "encouraged the president and members of the RTCG Council to commit the criminal act of non-execution of a final and enforceable court verdict and enabled the acquisition of illegal benefits to the illegally elected general director of RTCG Boris Raonić, thereby committing the criminal offense of incitement to the commission of a criminal offense from the Criminal Code of Montenegro".
"We have been informed by the media that the Special State Prosecutor's Office (SST) has formed a case regarding the criminal charges filed. We have also learned from the media that the consolidated case has been returned to the Basic State Prosecutor's Office (ODT) with the explanation that after the recently adopted amendments to the Law on the Special State Prosecutor's Office, the jurisdiction ceases of the Special State Prosecutor's Office in this case. In the meantime, a second final judgment was passed regarding the second illegal appointment of Boris Raonic to the position of General Director of RTCG. More than 8 months have passed since the criminal charges were filed on June 2023, 16, which violated the deadlines prescribed by Article 256a. of the Criminal Procedure Act in which the prosecution had to decide on the acceptance or rejection of applications (the maximum term is six months). Despite the final court verdicts, the SDT and the ODT did not determine whether the actions of the members of the RTCG Council and other persons against whom a criminal complaint has been filed, there are elements of a criminal act".
The Media Center notes that "it was confirmed by an undisputed final court verdict that at least the President of the RTCG Council Veselin Drljević violated the final court verdict and committed a criminal offense on Article 1 of the Criminal Code of Montenegro".
"We appealed to the Prosecutor's Council with a complaint on June 28 of this year and we have not received any response to date. We believe that the Prosecutor's Council, headed by Mr. Marković, can at least provide an answer regarding our complaint submitted 4 months ago and inform us about The media center addressed the VDT with the intention of drawing attention to the harmfulness of non-compliance with final court judgments and the very important role of the state prosecution in preventing anarchy if the prosecution does not process cases of non-compliance with final court judgments as a priority a clear message is being sent to the citizens that neither they nor any long-standing legal entities should respect the final decisions of the courts, because there will be no sanctions. By remaining silent and slow to react regarding the ignoring of final judgments, the state prosecutor's office becomes an accomplice in the collapse of the rule of law," it was announced. is.
The Media Center drew the attention of the State Prosecutor's Office to the fact that, based on the Law on State Prosecution, it has the possibility to submit a proposal for determining the disciplinary responsibility of the state prosecutor who does not act in this case.
"If Mr. Marković does not use the powers given by law, we can only state that it is about the political protection of the members of the Council and the General Director of RTCG, in which he also participates. If for VDT our call for action in case of non-compliance with court rulings is not important, then it we ask that, at least for the sake of the European Commission, it takes the necessary actions to show that it cares about the rule of law.
