Dragan Bulatović, who was a candidate in the competition for the secretary of the Podgorica Secretariat for Finance, announced that he expects the mayor of Podgorica, Olivera Injac, to legally appoint the secretary for finance in a repeated procedure, choosing one of the candidates who met the conditions of the public competition and successfully passed testing.
He stated in the statement that Balša Špadijer was illegally appointed to the position of Secretary of the Secretariat for Finance.
Bulatović, Jela Mrdak, as well as Sandra Marković, who, according to the decision, were informed that she did not meet the requirements of the competition, applied for the competition for the secretary of the Podgorica Secretariat for Finance, in addition to Špadijer.
"There is no doubt that the Secretariat for Financial Affairs and Budget Analysis of the Capital City is managed by an illegally appointed person, which was confirmed by the Appeals Commission of the Government of Montenegro by annulling the decisions of the mayor of Podgorica, not once but twice (May 23.05 and October 10.10.2024, 10.10.2024). I expect from mayor to act according to the Commission's decision of XNUMX and to follow the legal procedure appoints the secretary for finance, choosing one of the candidates who met the conditions of the public competition and successfully passed the test (Mrdak or Bulatović)," Bulatović pointed out in the announcement.
Bulatović added that he and Mrdak filed appeals against the Decision on the appointment of the Secretary of the Secretariat for Financial Affairs and Budget Analysis of the Capital City - Podgorica from March 1, 2024.
"Acting on appeals, the Appeals Commission annulled the aforementioned decision and sent the case back to the first-instance authority for re-proceeding and decision-making. However, the Mayor of Podgorica did not act in the repeated procedure as indicated by the Commission's Decision, but in a new Decision illegally appointed the same person as the secretary on 23.05.2024 July 26.07.2024. After that, the Appeals Commission also annulled this decision by the Decision of 10.10.2024/1/XNUMX. The essence of the illegal action in this particular case is that the person appointed as the secretary of the Capital City's Finance and Budget Analysis could not be found on the list of candidates who meet the requirements of the competition, because he did not submit it in time. proper evidence that he meets the requirements of the public competition in terms of prescribed work experience with the VIIXNUMX level of education qualification - at least three years of work experience in management positions or eight years of work experience in the same or similar positions in relation to for jobs for which a vacancy was announced," said Bulatović.
He stated that instead of being excluded from the procedure, Spadier was illegally allowed to access the testing and be appointed secretary.
"Even in the repeated procedure, he was asked to supplement the evidence of his work experience, although no substantive legal regulation allows for a legal situation in which such evidence is subsequently submitted. The above represents a flagrant illegal action that cannot be validated in the further course of the public tender procedure. of the competition documents submitted within the prescribed period, as from the subsequently submitted (invalid) evidence, it is clear that this person does not have the work experience required by the competition, that he did not deal with management or jobs that are the same or similar complex and responsible jobs in the public sector performed by the secretary of the Secretariat for Finance. From all of the above, it can be concluded that this person did not meet the requirements for acting secretary either, and that he has been illegally managing the Secretariat since July 2023," concluded Bulatović.
