The illegal building, which, according to the Municipality of Bijelo Polje, jeopardized the capital project of the World Bank, which provided EUR 4,5 million for the construction of a promenade with a coastal fort on Lim, was removed yesterday.
Yesterday, the "News" from the Directorate for Property and Protection of the Interests of the Municipality confirmed that the entire project is in jeopardy because of that facility.
The owner of the facility Vuk Noises, however, claims that the garage is not an illegal facility and that the Municipality did everything using manipulations.
The municipality paid 14 thousand euros for the multimillion-dollar project of a promenade on Lim, a coastal fort and a collector for 22,5 owners of illegal buildings, while one refused the deal, asking for more money. Those buildings, which are located in the body of the promenade, were previously demolished, and the investor's machines were circling around Zejak's garage for months, who instead of the offered 10,1 thousand euros, demanded the payment of around 33 thousand euros.
The building was demolished yesterday, as explained by the Director of the Property Directorate Ljubomir Sošić, the decisions of the Real Estate Administration were followed, both those related to the expropriation of the real estate itself and the decision on the permission to enter the property by the beneficiary of the expropriation - the Municipality of Bijelo Polje, "with the frequent insistence of the World Bank as the financier and coordinator of the project Vladan Dubljević, so that the multi-million dollar project would not be called into question, but to the benefit of the citizens of the municipality".
In parallel, in the body of the promenade, as told to "News" from the Municipality, a collector for wastewater treatment has already been connected, and work is currently being done on the construction of a fishing path with retaining walls, as well as a bridge over the Lješnica River near the Health Center.
Sošić reminded that the procedure for solving property-legal relations, i.e. expropriation, for those objects was carried out by the then Administration for Cadastre and State Property - Regional Unit Bijelo Polje back in 2021 and that everything was done according to the law.
"For 14 owners, EUR 22.413,55 was paid, while one building owner refused the payment. These are off-book buildings - garages," said Sošić.
Head of PJ Real Estate Administration Rajko Madžgalj he confirmed the knowledge of "Vijesta" that after determining the public interest, the expropriation procedure was carried out and the first-instance decision of the Real Estate Administration was made, which the representative of Vuk Zejak appealed to the second-instance authority, the Ministry of Finance.
Unsatisfied with the offered price, Zejak asked for a higher fee of 10.125 euros for a gross area of about 50 square meters for the building on the very coast of Lim, below the Petoletka building.
"The Ministry of Finance rejected the appeal and thus the decision became enforceable. However, in the meantime, Zejak initiated a dispute before the Administrative Court, in which he requests the annulment of the decision of the Ministry of Finance, which rejected his appeal against the decision of the Real Estate Administration PJ Bijelo Polje", said Madžgalj.
In the complaint, he stated that the construction of the building cost him much more, that the building is equipped with water, sewage and electrical installation, that it is decorated and has insulation, tiles...
"The price of that and other buildings was determined in April 2021 by the Commission of the Real Estate Administration before the expropriation began," said Madžgalj.
On September 16, the investor asked the Municipality of Bijelo Polje to remove the garage, which is in the way because it is on the construction route, due to the urgency of the work, explaining that they had been visiting the building until now, but that they had reached a part where they could no longer do so.
On October 8, the municipality appealed to the Real Estate Administration to allow entry into possession, i.e. transfer of real estate to the municipality, in accordance with the Law on Expropriation, "in order to enable the removal of the expropriated building - the garage, which would enable the continuation of work on the construction of the promenade, i.e. the contractor works enabled smooth operation".
"Vijesti" learns that in the Municipality's address to the Administration, it is stated "that it is a case of urgency and that there may be a possible delay and breach of deadlines in the performance of works, which is confirmed by the contractor's address to the Municipality about the necessity of removing the object in question as soon as possible".
After that, on October 18, the Real Estate Administration issued a decision that approved the request of the Municipality to hand over the immovable property based on the executive decision of the Real Estate Administration PJ Bijelo Polje, which ordered the off-book owner Vuk Zejak to expropriate the beneficiary to the Municipality within three days of receiving the decision. hand over immovable property. The Administration announced that if the owner of the garage forbids the Municipality from entering the property, a decision will be made to enforce the decision by force.
Zejak: Everything is legal, I was manipulated from the first day
The owner of the building, Vuk Zejak, claims that the garage is not an illegal building, no matter how much the Municipality claims that it is and that everything was done using manipulations from day one. He explained that the building was built on the land of Petoljetka, and that everyone built it behind his back, including yesterday's demolition, for which he received firm assurances from the President of the Municipality, Petar Smolović, and his associates, that it would not be demolished at least until November 24. when he arrives from Switzerland.
"They won a second-degree case of fraud, because they hired an ex officio lawyer, who instead of representing my interests, represented the manipulations of the Municipality and signed for me to agree to the demolition. Of course I will complain because from day one they did everything behind my back. When I was in a meeting with President Smolović and his associates 15 days ago, they promised me that they would inform me if there was a demolition. Last Sunday, the municipality informed my lawyer Petar Drobnjak that they planned the demolition and he repeated to them that I would arrive on November 24. I could have at least removed the video surveillance, lighting, wet room, mirrors and sinks, I left the phone number in the garage in a visible place, and all the municipalities had my contact", he said and visited that the process is in the Administrative Court and that they should have waited for the outcome of that decision.
He claims that it was a business building and not a garage, which, according to construction experts, was worth about 33.000 euros.
