Podgorica City Theater did not fulfill its legal obligation and did not publish the Guide for Free Access to Information (SPI) on its website.
This was also confirmed by the management of the City Theater in their response to "News", stating that the production is in progress.
"We inform you that the Guide for Free Access to Information (SPI) is under construction," reads the reply that was delivered to the editorial office on November 20.
They submitted the answer after the journalist's second inquiry - the first time "Vijesti" submitted the inquiry about the guide on the seventh, and after the City Theater did not respond, the inquiry was repeated on November 19.
The Agency for the Protection of Personal Data and Free Access to Information confirmed to the editors that the City Theater Podgorica is obliged to publish the Guide on November 8, after asking the editors whether the institution, given that its founder is the Podgorica Municipal Assembly, is obliged application of the Law on SPI, as well as whether, in accordance with that, the obligation to publish the guide on its website.
"Having in mind the provision of Article 9 paragraph 1 item 1 of the Law on SPI, which stipulates that the authority is an institution, a business company and another legal entity whose founder, co-founder or majority owner is the local self-government, JU Gradsko pozorište Podgorica is bound by the Law on SPI and on the basis of Article 11 and Article 12 paragraph 1 point 1 of the Law on SPI, it is obliged to publish the Guide for free access to information on its website", it is written in the answer sent by the Agency to "Vijesta".
As they added, the Agency will, in accordance with its powers, initiate the procedure of inspection supervision.
According to the Law on SPI, in the part that refers to the Guide (Article 11), "the authority is obliged to create, publish on its website and regularly update a guide for accessing information in its possession".
"The guide for access to information contains a catalog of types of documents, including public registers and public records, address and e-mail address for submitting requests, contact phone number, data on responsible persons, costs of access to information and other data that are important for achieving access to information which is owned by the authority", the Law states.
As it is added, the authority is obliged to update the information access guide at least once a year, that is, within 30 days from the day of the change in the types of information in its possession and data important for information access.
"The authority is obliged to provide access to the information it possesses, even though the information access guide does not contain that information. The authority is obliged to designate the person who is in charge of dealing with requests for access to information, as well as the person who will replace him in case of his absence", the Law states.
In Article 12, in the chapter "Proactive access to information", among other things, it is stated that the authority is obliged to publish on its website, among others, a guide for access to information, public registers and public records, programs and work plans, reports, contracts on the disposal of financial resources from public revenues and state property, the list of civil servants and employees, with their official and employee titles, as well as the list of public officials and the list of calculations of their wages and other incomes and benefits in connection with the exercise of public functions, decisions and other individual documents that are important for the rights, obligations and interests of third parties, as well as information to which access has been granted upon request...
