The Agency for the Prevention of Corruption (ASK) has determined that Aleksandra Jovanovic violated the law because she simultaneously held two public positions - she was a member of the board of directors of the state-owned enterprise "Biznismontenegro" and the health institution Pharmacy of Montenegro "Montefarm".
This is stated in the ASK decision signed by the acting director of that institution. Dušan Drakić.
The agency initiated the procedure based on a report stating that Jovanović held two positions at the same time, which is in violation of the Law on the Prevention of Corruption.
"The public official emphasized in her statement that she did not dispute the allegations in the summons and that she did not know that these were two incompatible positions, and that after learning this, she resigned from her position as a member of the Board of Directors of Biznismontenegro," the decision states.
ASK, through its database, determined that Jovanović held two positions.
"The new law, which entered into force on 12.06.2024, stipulates that only conflicts of interest and whistleblower reports must be resolved under the old law, which indisputably implies that all initiated proceedings will be completed under the provisions of the new Law on the Prevention of Corruption. This is also supported by the act of the Ministry of Justice as the authorized proposer of the law, which emphasizes that initiated proceedings in which it is decided whether a public official has violated the provisions of the law relating to restrictions on the performance of public functions, gifts, sponsorships, donations and reports on income and assets will be completed under the provisions of the current law," the decision states.
The ASK concludes that after evaluating the evidence, part of the Agency's database and the statement of the public official, they determined that Jovanović violated Article 14 of the Law on the Prevention of Corruption because, at the same time as a member of the Board of Directors of "Biznismontenegro", she also performed the public function of a member of the Board of Directors of "Montefarma".
ASK previously made a similar decision in the case of the former director of "Montefarma" Goran Marinović who was also the president of the Board of Directors of “Biznismontenegro”. Marinović claimed in his statement that he did not know that he could not perform both functions at the same time, while the ASK, according to the decision, determined that the former director of “Montefarm” violated Article 12 of the Law on the Prevention of Corruption, which stipulates that a public official cannot be the president or member of the management and supervisory body, executive director, member of the management of a public enterprise, institution or other legal entity…
