Former President of Montenegro Milo Đukanović announced that he will file a lawsuit with the Administrative Court after the Agency for the Prevention of Corruption submitted a decision stating that he violated the Law on the Prevention of Corruption.
"The adoption of an administrative act, without the prior opportunity for me to comment on the results of the investigation, despite the explicit legal obligation of the Agency for the Prevention of Corruption (ASK) to provide me with this right, indicates an obvious intention to violate Article 14 of the Law on Administrative Procedure. Such conduct, in itself, implies holding accountable those who knowingly and intentionally violate the law, in order to meet the expectations of those protagonists of the political scene under whose pressure they work, and who see their political work as nothing more than trite sensationalism of this type," Đukanović's statement reads.
He says that the "tendency for cheap and targeted sensationalism" is also indicated by the publication of the decision and "informing the media before the decision is delivered to the party to which it applies."
"Regarding the legal illiteracy of the decision, everything that needs to be said will be found in the lawsuit that I will file with the Administrative Court, immediately after I am finally honored to receive the decision in question. This, in addition to ignoring the fact that the competent court issued two judgments in my favor, which factually and legally confirm that the alleged debt to the bank did not exist and establish a violation of personal rights, due to the presentation of brutal untruths, also implies pointing out a flagrant violation of the Law on Credit Institutions by publicly publishing account data, contrary to Articles 203-205 of the Law, although the publication of this data is not necessary for making a lawful decision," he adds.
Therefore, as he said, it should be clear to everyone that "this was precisely the goal of this joint venture with a transparent political background", in order to "buy time to heat up this topic in the coming period, by abusing all available institutions for that purpose".
"And finally, to satisfy the interest of those who would manipulate the public with this very goal and to tell them that my family at all times in the period from 2007-2015, which is the focus of interest of curious sensationalists, had sufficient legally acquired funds to settle every due obligation on this and every other account that we used for our own needs, and without any connection to the public functions that I performed," the statement reads.
