Lamb Đuro Marđonović He filed a criminal complaint against the Municipality for abuse of office because, as he claims, they want to demolish a part of his house that was not part of the expropriation for the road, thereby violating his safety and property. The Municipality of Bar claims that the procedure is over, and that Marđonović was not ready for an agreement.
As Marđonović told "Vijesti", he filed a complaint against the responsible persons in the Municipality of Bar, who verbally and by sending the Municipal Police announced the demolition of the components of his house that were not subject to any expropriation.
Apparently, workers from “Bemax”, who are building a local road that will connect Šušanj with Bulevar 24. novembra, have marked its septic tank and stairs. The part of the road around the septic tank is the only unfinished part on the road.
He was also informed that the Municipality had requested the police to assist in the demolition on Thursday, March 6. He informed the Chief of Police of Bar, the Director of the Police Administration and the Minister of Internal Affairs about all this. He also wrote to the President of the Bar Municipal Assembly about this issue. Branislav NenezićHe hasn't received any answers yet.
"I warned that assisting the police would be illegal and that it would be complicity of the police in the commission of a criminal offense. I warn again that the Municipality did not expropriate my house or parts of the house, and that consequently it has no right to demand any demolition of the septic tank, terrace, staircase. Only part of the land and one wall were expropriated, but not parts of the house that they intend to demolish," Marđonović wrote.
If that happens, according to him, the Municipality will leave him and his 87-year-old immobile mother to live in a life-threatening ruin, because the house would be dilapidated, without sewage, and would endanger their lives and health.
"I will defend our property with my immobile mother's body, so those who intend to demolish our property illegally will first have to drive over us with excavators. The neighbors have informed me that they will gather and give us support," said Marđonović.
When asked what solution he offers for this problem, Marđonović replied that he is asking the Municipality to carry out subsequent expropriation of the septic tank, and especially the staircase or the entire house, since the staircase connects the lower floor and the upper rough works.
The Municipality of Bar offered Marđonović an agreement regarding the demolition, but he did not want to sign such an agreement because, as he said, it was proposed in complete contradiction to the regulations and what had been agreed upon and what had been communicated to him verbally earlier.
The Bar local government was not aware that Marđonović had filed a criminal complaint.
They stated that this is a person who is the former owner of a cadastral plot, from whom the Municipality, on the basis of a complete land expropriation procedure conducted before the competent Real Estate Administration - PJ Bar, at the proposal of the Municipality itself, in the period from October 2022 to September 2024, acquired ownership of the land, with an area of 671 square meters.
They also noted that in the name of fair compensation for land and land rights for the realization of the road, the Municipality paid one and a half million euros in the expropriation process, and specifically to Đuro Marđonović a total amount of 138.689 euros, of which compensation for land amounted to 113.399 euros, then for building rights an amount of 17.600 euros, as well as an amount of 7.690 euros based on estimated plantings.
They also said that Marđonović participated in public hearings in the expropriation process for the past two years. That process ended at the end of May last year, and at the end of August, Marđonović filed a request for compensation, which the Municipality acted upon, and ownership of the land was transferred to her.
"The expropriation procedure was legally and enforceably completed in relation to the named person more than six months ago, with the construction works on the road in its final phase, all that remains is to remove the septic tank located in the body of the road, along with part of the nearby sidewalks and stairs planned on the route of the pedestrian path," the local administration said.
The buildings, as they state, are indisputably located on a cadastral plot in the property of the Municipality, however, part of the sidewalk and stairs to which it continues are located next to the Marđonović family's residential building, and he does not want to allow their removal despite several unsuccessful attempts to reach an agreement with him over the past months.
"The removal of these surfaces would be carried out with full caution and without any damage to the neighboring building. Given that there was no possibility of a negotiated solution to the situation, and Marđonović persists in his intention not to allow the contractor to complete the work, despite the intervention undertaken by the Communal Supervision Service - Communal Police, the Municipality, for its part, was forced to contact the Police Directorate with a request for assistance," they told "Vijesti".
They also pointed out that during the construction of the road, several buildings located on the route were removed, and the former owners were duly paid the corresponding compensation.
"Construction works were only started after the final completion of the procedure for the complete expropriation of land previously owned by the named person and other former owners and the payment of the established compensation for the land and construction and agricultural properties, or rather, the plantings. After that, after conducting a tender procedure for the selection of the contractor for the works in question and concluding a contract with the selected bidder, the Municipality appointed expert supervision and, as already mentioned, only after the resolution of property and legal relations on the entire land within the scope of the planned road, or the transfer of ownership in favor of the Municipality, in mid-September last year officially introduced the contractor to the construction of the road."
