Protector of Human Rights and Freedoms: Without independent, free and credible media, there is no free society

"We also draw attention to the ongoing campaign against women in public life, in connection with allegations that MP Jevrosima Pejović has been subjected to insults, misogynistic and sexist comments for launching an initiative that is intended to facilitate the position of women at work," the statement said.

The Protector of Human Rights and Freedoms of Montenegro expressed concern regarding recent cases of threats to the safety of Montenegrin journalists and condemned any type of pressure and attacks, as well as the suppression of freedom of public speech.

"We were informed through the media about the case of threats against RTCG journalist Duška Pejović in a public place, who is, among other things, recognized for her long-standing engagement with human rights and freedoms, and since the beginning of the year, the media has also reported on other cases to the detriment of journalists, such as insults via social media, requests for a security assessment, etc.

"Based on the latest assessment by the Safe Journalist organization that women in the media in Montenegro are still exposed to violence, discrimination and professional insecurity, and in accordance with information about online and offline pressures and attacks on journalists, we also take this opportunity to condemn all types of threats to the security and independence of the media and urge that the reports be effectively investigated and processed, especially the motives, because only a decisive systemic and institutional reaction can be an effective response and improve the situation in this area," the Protector's statement states.

United in condemnation and reactions, without selection and division in relation to the media and individuals, we must build a safer working and living environment for members of the journalism profession, the Office of the Protector adds, because without independent, free and credible media there are no free institutions, no debate on issues of general importance and interest, and therefore no free society.

"Regarding the prosecution of journalists for their reporting and expressed views, as a restrictive measure, we have repeatedly pointed out that this can only be applied in extremely justified situations, in accordance with international practice, standards and recommendations in this area, as a necessary measure, used after all other options have been exhausted and must last as short as possible. In the context of current events, we remind you that journalists and other public figures play a key role in promoting freedom of expression, which is not only important in itself, but also has a central role in protecting other rights under the Convention," the statement emphasizes.

The Protector also reminded that freedom of expression has its limits, which are established by domestic law, but even more so by international standards - in which the judgments of the European Court of Human Rights are at the forefront, which have primacy over national legislation. At the same time, any limitation of freedom of speech must be applied restrictively, i.e. any interference with freedom of speech must meet the prescribed conditions (Article 10 of the European Convention on Human Rights).

"We also draw attention to the ongoing campaign against women in public life, in connection with allegations that MP Jevrosima Pejović has been subjected to insults, misogynistic and sexist comments for launching an initiative that is intended to facilitate the position of women at work. Regardless of someone's personal and collective views on the justification of this idea, we condemn attacks based on personal characteristics and call for a culture of dialogue and reasoned discussion in public discourse and the media," the statement concludes.
