The Basic State Prosecutor's Office in Kolašin (ODT) is conducting a preliminary investigation into the criminal complaint recently filed with the Special State Prosecutor's Office (SDT) by the Municipal Committee for Spatial Planning, Utilities, Housing and Traffic against the owner and responsible persons of the company "Bjelasica Invest", the previous chief city architect, as well as the designer, auditor, contractor, supervisory authority, inspectors and other unidentified persons who were involved in the design and construction of the facility on Mirka Vešovića Street.
"The procedure is in the survey phase, documentation has been obtained from the Ministry of Spatial Planning, Urbanism and State Property, and an on-site inspection is planned today in the presence of geodetic and construction experts. The experts have been assigned the task of conducting an expert assessment by order, and accordingly, the necessary measurements will be carried out in the field," the head of the ODT told "Vijesti". In Mirka Vešovića Street, on cadastral plot 317/3 in the center of Kolašin, the construction of a hotel based on the condo business model has advanced, with the investor being “Bjelasica Invest”. As stated in the criminal complaint, which “Vijesti” had access to, “the project shows that the basement floor is planned to have larger dimensions than those allowed by the UTU and DUP, that is, the basement floor extends beyond the construction line”, which, according to the committee, is strictly prohibited by the Law on Construction of Buildings.
Among other alleged omissions and violations in the construction of the hotel, they also state that the street is an extension of the staircase, so it is "clear that the safety of drivers is not guaranteed."
The signatories of the criminal complaint say that "if such illegal construction remains, it will result in either the closure of the street or the demolition of the staircase."
They also explain that "the investor has gone outside the construction line with the garages on two sides, the eastern one, towards Mirka Vešovića 1, and the northern one, towards the local street that goes further towards the Distribution building and the residential building located across from the Bjanka Hotel". They also suspect that "an additional danger is the height of the building and the potential for snow to fall from the roof, which also makes the building dangerous for other people".
The signatories of the criminal complaint say that “if such illegal construction continues, it will result in either the closure of the street or the demolition of the staircase”. They also explain that “the investor has gone outside the construction line with the garages on two sides, the eastern one, towards Mirka Vešovića Street 1, and the northern one, towards the local street that further leads to the Distribution building and the residential building located across from the Bjanka Hotel”.
The project of the company "Bjelasica Invest" represents a flagrant example of disregard for urban planning regulations, KANA/Ko akto ne arhitekt recently announced. They remind that one of the co-owners of the company Damir Davidovic, who is currently the Acting State Secretary at the Ministry of Spatial Planning, Urbanism and State Property. The KANA organization, with the support of the Green Kolašin initiative, has been warning about the way the hotel is being built for more than a year.
"By appointing Davidović as head of the Ministry of Spatial Planning, the message is sent that laws and regulations have no weight, and that they can be circumvented without consequences. How can we expect to improve spatial planning when the institution is led by a person who actively participates in its collapse," they said in a statement.
