New Acting Executive Director of the Public Utility Company Milan Perovic filed a criminal complaint with the Budva police against the previous acting director of that municipal company Ilija Gigović, accusing him of committing the criminal offense of taking and destroying an official seal and official document.
In the report, which "Vijesti" had access to, Perović states that Gigović did not return the company's seal for a full 18 days.
Perović is a member of the "Budva Our City" list, which was led by the current mayor of Budva in the last local elections. Nikola JovanovicHe was previously assistant to the acting director of that company. Dear Drago Ivanovic.
Gigović, on the other hand, is a councilor of the "For the Future of Budva" list and while he was at the helm of the Municipal Company, together with the then Board of Directors, he filed several criminal charges against former acting director Ivanović and then assistant Milan Perović, accusing them of preventing them from working and entering the company, and of committing a series of frauds.
Gigović resigned from the company in early March, after Perović was appointed acting director.
"Ilija Gigović was appointed by the Board of Directors of DOO "Komunalno" Budva as Acting Executive Director by the Decision of November 11 last year. Based on the aforementioned decision, he changed the registration in the CRPS in his name, and the authorization to represent the Company with banks was also changed. This registration was made after the Board of Directors, as well as the founder of the Company, made a decision to dismiss him from the position of Acting Director. This decision was submitted to the competent institutions for further action, and after it was made in the opinion of the Ministry of Finance, as a second-instance body. Ilija Gigović and Rasko Radulović, as the president of the then Board of Directors, declared the Company's seal invalid on December 27th last year. The fact that the seal was declared invalid was published in the Official Gazette," Perović stated in the criminal complaint.
Perović points out that they learned from the media that Gigović had created a new seal.
"The said seal was never physically delivered to the Company, and our only information about it and its appearance comes from the media. Komunalno Budva contacted Gigović on February 27, when he was served with the Decision on dismissal from the position of acting executive director. In the same letter, he was asked to return the seal, which he had made and keeps outside the Company's premises, as soon as possible, which is contrary to the Company's acts and positive regulations of Montenegro. Komunalno received from the lawyer on March 6 Dijane Petkovic, who in the proceedings in question declares herself as the attorney-in-fact of Ilija Gigović, in which she states that Ilija Gigović's ownership of the seal arises from his capacity as acting officer. The attorney-in-fact was informed that the seized seal cannot be used, and that she is obliged to return it to the premises of Komunalno Budva," the criminal complaint states.
Perović claims that with regard to the above actions, the basic principle of legality of business operations cannot be violated, and all in accordance with the general power of attorney.
"We would like to point out that we have confirmed this, but with the condition that the handover of one can be carried out within a period not exceeding five days. Since the obligation was not fulfilled within the stated period, on March 12, the Legal and General Affairs Service, or rather Mirjana Miranović, spoke with the attorney of Ilija Gigović, who stated that she immediately informed her employer about the letter received from DOO Komunalno Budva, and that she informed him that due to the large number of obligations previously undertaken, she was unable to come to Budva. She also emphasized that she asked him to hire another attorney from the territory of the municipality of Budva or Kotor to hand over the seal instead of her. In the end, she said that this would happen by the end of the working week, that is, by March 14th," Perović emphasized in the application.
He reminds us that everything was preceded by the dismissal of Ilija Gigović.
"Namely, on March 4, Gigović made a statement, which he certified at a notary, which contains his desire to terminate his employment. In accordance with the aforementioned statement, which was filed on March 6, Komunalno Budva issued a decision to terminate the employment contract. To date, 18 days after the termination of his employment at Komunalno, Gigović has not returned the seal of this Company and has been keeping it outside the premises of Komunalno without authorization since December 2024. By such actions, Gigović committed the criminal offense of taking away and destroying the official seal and official file under Article 382 in conjunction with the criminal offense of negligent work in the service under Article 417 of the Criminal Code of Montenegro. We believe that this criminal report is justified and based on the law, so we suggest that you carry out all actions provided for by law," concluded Perović.
The Basic State Prosecutor's Office in Kotor formed a case, as "Vijesti" reported at the end of January, and initiated pre-trial proceedings regarding the events at the Budva Municipal Enterprise after Gigović and the then Board of Directors filed several criminal charges because the dismissed management refused to allow them to manage the company.
